Direito Real de Laje: um estudo sob a óptica da regularização fundiária urbana

Abstract

O presente trabalho tem como objetivo analisar o Direito Real de Laje sob a perspectiva da regularização fundiária urbana. O instituto foi adicionado ao ordenamento jurídico pela Medida Provisória n° 759/2016, posteriormente convertida na Lei n° 13.465/2017. Apesar de sua recente positivação, o Direito de Laje já era vivenciado há bastante tempo nas favelas. Para compreender se o direito positivado é capaz de regularizar lajes já existentes, foram estudados os requisitos legais para sua instituição. Por meio do método de abordagem dedutivo, foi verificado que ainda é cedo para se afirmar, categoricamente, se o instituto será eficiente do ponto de vista da regularização fundiária urbana. É vista com ressalva, contudo, a previsão do § 9° do artigo 176 da Lei n° 6.015/1973, incluído pela Lei n° 13.465/2017, vez que pressupõe a matrícula da propriedade da construção-base.

This study aims to analyze the slab right from the perspective of urban land regularization. The institute was added to the legal system by Provisional Measure n° 759/2016, subsequently converted into Law n° 13.465/2017. In spite of its recent positivation, the slab right was already experienced for a long time in the favelas. In order to understand if the positive law is able to regularize existing slabs, the legal requirements for its institution were studied.Through the method of deductive approach, it was verified that it is still early to assert, categorically, if the institute will be efficient from the point of view of urban land regularization. The provision of § 9° of article 176 of Law n° 6.0115/1973, included by Law n° 13.465/2017, however, is seen with reservation.
