Na mira do sistema penal: o processo de criminalização de adolescentes pobres, negros e moradores da periferia no âmbito do sistema penal catarinense

Abstract

O presente trabalho tem como objeto o processo de criminalização de adolescentes pobres, negros e moradores da periferia no âmbito do sistema penal catarinense, incluindo a Polícia, o Judiciário e o Sistema Socioeducativo. Sustenta a tese de que o menor infrator é um efeito da ação do sistema penal e das instituições de controle social na área da infância e da juventude, sendo produzido através de um processo de criminalização que atinge, principalmente, adolescentes pobres, negros e moradores da periferia. Tem por objetivo geral analisar o processo de criminalização juvenil no âmbito do sistema penal catarinense, buscando compreender a dinâmica de produção/reprodução de menores infratores como parte do sistema de dominação capitalista, de caráter simultaneamente classista e racista. Para tanto, faz análise documental de processos de apuração de ato infracional e de execução de medida socioeducativa, com pesquisa empírica realizada nos Juizados da Infância e da Juventude da Capital, de Chapecó e de Joinville. Na primeira etapa da criminalização juvenil, mostra como a Polícia constrói a figura do menor suspeito , a partir de estereótipos e preconceitos sociais e raciais, passando a vigiá-lo e persegui-lo até lograr sua apreensão. Na etapa judicial, evidencia como o Judiciário processa, julga e condena o adolescente criminalizado, começando pelo mecanismo da confissão até o aparecimento do menor perigoso representado pelos antecedentes infracionais. Na estratégia de guerra às drogas, indica que a criminalização se intensifica ao rotular o adolescente de traficante , fazendo dele um novo inimigo público cada vez mais na mira do sistema penal. Na última etapa da criminalização juvenil, aborda a passagem do adolescente criminalizado pelo Sistema Socioeducativo, onde ele tem de enfrentar condições desumanas para cumprir sua medida socioeducativa ou sociodisciplinar, sendo submetido a um plano de atendimento geralmente frustrado em sua expectativa de docilização. Observa que, por trás do fracasso na correção do socioeducando , revela-se o sucesso na consolidação do rótulo de menor infrator . Enfim, conclui que o adolescente criminalizado, para ser transformado em menor infrator , percorre todo o caminho da criminalização juvenil, enquanto objeto de controle da Polícia, do Judiciário e do Sistema Socioeducativo.

Abstract : The present work has as object the process of criminalization of poor teenagers, blacks and residents at the periphery in the context of the criminal justice system catarinense, including the Police, the Judiciary and the Socio Educational System. Defend the thesis that the "underage infractor" is an action effect of the criminal justice system and the institutions of social control in the area of childhood and teens, being produced through a process of criminalization that affects mainly of poor teenagers, blacks and residents at the periphery. The general goal is to analyze the process of juvenile criminalization in the context of the criminal justice system catarinense, seeking to understand the dynamics of production/reproduction of "underages infractors" as part of the system capitalist domination, with character simultaneously classist and racist. For this, makes documentary analysis of infraction act investigation processes and execution of social educative measure, with empirical research realized in the Juvenile Courts of the Capital, Chapecó and Joinville. In the first step of juvenile criminalization, shows how the Police builds the figure of the "underage suspect", from stereotypes and prejudices social and racial, going to watch it and pursue until to attach him. In the judicial step, evidence how the Judiciary processes, judges and condemns the criminalized teenager, starting by the mechanism of confession until the appearance of the "underage dangerous" represented by the background infractions. In the strategy of war on drugs, indicates that the criminalization intensifies the labeling the teenager of "trafficker", making him a new "public enemy" increasingly in the crosshairs of the criminal justice system. In the last step of the juvenile criminalization, approach the passage of the criminalized teenager by the Socio Educational System, where he has to face inhumane conditions for fulfill it social educative measure or social discipline, being subjected to a work plan usually frustrated in their expectation to become docile. Notes that, behind the failure in the correction of social educating", reveals the success in the label consolidation of "underage infractor". Finally, this work concludes that the criminalized teenager, for be transformed into a "underage infractor", runs all the way to the juvenile criminalization, as an control object of the Police, the Judiciary and the Socio Educational System.
