Uma Análise Jurídica da (Des)Necessidade da Regulamentação das Moedas Digitais

Abstract

O Bitcoin surgiu há pouco tempo, contudo, causou intensos debates na área acadêmica sobre a necessidade ou não de sua regulamentação. Este trabalho tem por objetivo contribuir para encontrar uma resposta a tal controvérsia, debatendo quanto à necessidade ou não de sua regulamentação e, em caso afirmativo, quais os limites dessa intervenção. Para tanto se baseia em obras escritas por autoridades de diversas áreas do conhecimento, além analisar o projeto de lei que visa regulamentar o Bitcoin no Brasil. No intuito de elucidar essa problemática, a partir de pesquisa bibliográfica e documental, o presente trabalho desenvolve-se em três capítulos. Assim, em um primeiro ponto analisa-se a tecnologia empregada pelo Bitcoin, bem como conceitos fundamentais para poder debate-lo. No segundo capítulo busca-se apontar a natureza jurídica das moedas digitais, e, finalmente, no terceiro e último capítulo é exposto o cenário regulatório atual, visando concluir se há ou não necessidade da regulamentação.

Bitcoin emerged recently, however, due to its potential, caused intense debates in the academic area on the necessity or not of its regulation. This paper aims to contribute to find a response to this controversy. To do so, it is based on works written by authorities in various areas of knowledge, in addition to analyzing the bill, which seek to regulate Bitcoin, which is processed in the chamber of deputies and other legislations that may affect it. In this way the present work is divided into three chapters, in a first point it analyzes the technology used by Bitcoin, as well as fundamental concepts to be able to debate it. In the second chapter, it is sought to indicate in which legal basis the digital coins can be framed. Finally, the third and last chapter exposes the current regulatory scenario, aiming to conclude whether or not there is a need for regulation.
