Soberania Popular e mecanismos de participação: a revogação de mandato eletivo

Abstract

O sistema político brasileiro, apesar de se enquadrar dentro do conceito de democracia semidireta, não abarca qualquer instituto que permita que a própria população possa dispor de sua soberania e revogar mandato eletivo. O recall dos Estados Unidos e o Abberufungsrecht da Suíça são institutos de revogação de mandato eletivo em que seus eleitores podem, através de novo processo eleitoral, “deseleger” os candidatos eleitos. A partir dos conceitos de Soberania Popular e Democracia, este trabalho analisa a inclusão de institutos de revogação de mandato eletivo no sistema jurídico brasileiro. Dessa análise, é possível verificar que a inclusão desses institutos não contraria o texto constitucional, sendo cabível a propositura de emenda constitucional.

The Brazilian political system, although it falls within the concept of semi direct democracy, does not encompass any institute that allows the population itself to have its sovereignty and to revoke elective mandate. The recall of the United States and the Abberufungsrecht of Switzerland are institutes for the repeal of elective term in which their voters can, through a new electoral process, "unelect" the elected candidates. Based on the concepts of Popular Sovereignty and Democracy, this paper analyzes the inclusion of institutes for the revocation of elective term in the Brazilian legal system. From this analysis, it is possible to verify that the inclusion of these institutes does not contradict the constitutional text, being possible the proposal of constitutional amendment.
