A consolidação da proteção jurídico-estatal brasileira ao instituto do casamento homoafetivo: uma abordagem garantista dos direitos à liberdade e igualdade de orientação sexual e identidade de gênero

Abstract

O presente trabalho aborda o instituto do casamento homoafetivo como instituto protegido e consolidado pelas Cortes Superiores brasileiras. Aborda, com base na teoria do garantismo jurídico, os direitos de liberdade e igualdade de orientação sexual e identidade de gênero como as bases legitimadoras do reconhecimento do casamento homoafetivo. Discorre acerca da árdua história da comunidade LGBT, e do movimento pelos direitos homossexuais, desde os primórdios da Antiguidade, até os dias atuais. Analisa o desenvolvimento da jurisprudência concernente a casais do mesmo sexo, desde 1989, e aborda a onda de provimentos dos tribunais de justiça culminando com a edição da resolução n. 175/2013 do Conselho Nacional de Justiça que garantiu o direito ao casamento homoafetivo. Defende o direito ao casamento homoafetivo com base nas mudanças no conceito de família, o qual abarca a nova entidade familiar “homoafetiva”. Também relaciona esse direito ao respeito aos Direitos Humanos reconhecidos pela comunidade internacional. Por fim, aborda, sob uma perspectiva garantista, os princípios ou direitos fundamentais de Liberdade e Igualdade de orientação sexual e identidade de gênero como solução à legitimidade jurídica do instituto do casamento homoafetivo. Subdivide essa liberdade em quatro prismas : liberdade sexual, de afeto, de privacidade e liberdade perante a lei. Ressalta a fundamentalidade do Princípio ou Direito da Igualdade ou isonomia que vincula tanto o legislador na elaboração da lei, como os aplicadores da lei, especialmente o Judiciário. Defende-se a impossibilidade de violação à igualdade de orientação sexual por meio de discriminações preconceituosas. Por fim analisa a atuação do Poder Judiciário como legítima e garantista, em oposição à inércia do Poder Legislativo.

The present work approaches the homo-affective marriage as a protected and consolidated institute by the Brazilian Superior Courts of Justice. Based upon the juridical garantism theory it approaches the rights of liberty and equality of sexual orientation and gender identity as the legitimacy basis of the recognition of the homo-affective marriage. It talks about the hard history of the LGBT community, and of the homosexual rights movement, since the beginnings of the Ancient era to the present days. It analyzes the court's precedents development concerning same-sex couples, since 1989, and approaches what it calls the wave of resolutions of the State's courts of Justice that ended on the edition of resolution no. 175/2013 of the National Council of Justice, that granted the right to the homo-affective marriage. It defends the right to the homo-affective marriage based on the changing concept of family, which now gathers the new familiar “homo-affective” entity. It also relates that right to the respect of the Human Rights recognized by the international community. At last, it approaches, under a garantist perspective, the principles or fundamental rights of Liberty and Equality of sexual orientation and gender identity as a solution to the legitimacy of the homo-affective marriage institute. It divides that liberty in four perspectives: sexual liberty, affection liberty, privacy liberty and liberty towards the law. It is emphasized the fundamental character of the Principle or Right to Equality or isonomy, that binds the legislator in the elaboration of the law, as much as the Law appliers, especially the Judiciary. It is defended the impossibility of violation of the sexual orientation equality by means of prejudicial discrimination. In the end it analyzes the acting of the Judiciary Power viewed as legitimate and garantist, in opposition to the inertia of the Legislative Power.
