dc.description.abstract A presente dissertação visa analisar a participação do amicus curiae no âmbito do Tribunal Penal Internacional. Para tanto, o primeiro capítulo trata do instituto do amicus curiae de um ponto de vista histórico e também do direito comparado, com a análise das legislações norte-americana e brasileira sobre o assunto. O segundo capítulo versa sobre a internacionalização do amicus curiae a partir da sua previsão no ordenamento jurídico interno, verificando as jurisdições abertas e refratárias a essa participação. O terceiro capítulo estuda a participação do amicus curiae nos Tribunais Penais Internacionais para a Antiga Iugoslávia e Ruanda tendo por base a sua jurisprudência, traçando uma linha evolutiva das jurisdições penais internacionais de forma a fornecer bases teóricas para a compreensão do tema. Por fim, o último capítulo finaliza a análise evolutiva das jurisdições penais internacionais ao abordar a criação e funcionamento do Tribunal Penal Internacional, para então adentrar na questão da participação do amicus curiae perante essa jurisdição permanente. Após uma análise jurisprudencial sobre a questão, são propostas diretrizes gerais para a participação de amicus curiae perante o Tribunal Penal Internacional, levando em consideração, no que for cabível, a experiência das jurisdições domésticas e internacionais estudadas, mas, principalmente, das jurisdições penais internacionais ad hoc, nos casos em que se verificar omissão na jurisprudência do Tribunal permanente.<br> pt_BR
dc.description.abstract Abstract : This thesis aims to analyze the participation of amicus curiae in the International Criminal Court. Therefore, the first chapter deals with the amicus curiae institute from an historical and comparative law point of view, with an analysis of U.S. and Brazilian laws on the subject. The second chapter focuses on the internationalization of amicus curiae from the domestic legal system, verifying the open and refractory jurisdiction to such participation. The third chapter examines the participation of amicus curiae in the International Criminal Tribunals for the Former Yugoslavia and Rwanda on the basis of its jurisprudence, drawing an evolutionary line of the international criminal jurisdictions in order to provide theoretical basis for understanding the topic. Finally, the last chapter concludes the evolutionary analysis of the international criminal jurisdictions to address the creation and functioning of the International Criminal Court, and then enter the question of amicus curiae participation before this permanent Court. After the jurisprudential analysis on the issue, general guidelines are proposed on the participation of amicus curiae before the International Criminal Court, taking into account, where applicable, the experience of the domestic and international jurisdictions studied, but mainly of the ad hoc International Criminal Tribunals, in the cases where an omission is verified in the jurisprudence of the permanent Court. en
