Refugiados ambientais: desafios à sua aceitação pelo direito internacional

Abstract

O surgimento de uma nova categoria de refugiados no âmbito dos deslocamentos forçados figura como a problemática principal deste estudo. Ainda que a movimentação em razão de adversidades ambientais não seja deveras recente, a preocupação com o seu reconhecimento jurídico se faz premente nas discussões internacionais hodiernas. Deste modo, o objetivo geral do trabalho consiste em analisar as possibilidades de aceitação dos refugiados ambientais pelo Direito Internacional, como forma de garantir-lhes os direitos necessários a uma vida digna. Para tanto, será apresentada a gênese e o desenvolvimento do instituto jurídico do refúgio, bem como a construção do seu aparato normativo, em âmbito global e regional, inserido em uma ótica de análise evolutiva do conceito legal de refugiado. Posteriormente, examinar-se-á a sua adequação com a natureza dos problemas ambientais. Ademais, será estudada a formulação doutrinária da definição de refugiado ambiental, a qual prima como fundamento na composição de instrumentos internacionais voltados à solução da presente contenda, além das causas ambientais que resultam nesta categoria de deslocamento forçado. Por fim, analisa-se a capacidade de reconhecimento e proteção dos refugiados ambientais pelo Direito Internacional. Dentro desta perspectiva verifica-se a adequação do arcabouço normativo vigente com a necessidade de proteção premente dos refugiados ambientais, e a responsabilidade internacional que deve ser imputada aos Estados para tentar solucionar esta problemática. São trazidos, ainda, os limites e as novas alternativas para que os refugiados ambientais sejam aceitos juridicamente na esfera internacional.

The emergence of a new category of refugee in the context of forced displacement figure as the central issue of this study. Although the movement motivated by environmental adversity is not quite recent, concern about their legal recognition becomes urgent in today#s international debates. Thus, the aim of this work is to analyze the possibilities of acceptance of environmental refuges under international law, as a way to guarantee the necessary rights to live a dignified life. Therefore, it will be presented the genesis and development of the legal institution of refuge, as well as the construction of its regulatory apparatus, at the global and regional sphere, inserted in a perspective of an evolutionary analysis of the legal concept of refugee in order to assess, later, their adequacy with the nature of environmental problems. In addition, consideration will be given to doctrinal formulation of the definition of environmental refugees, which figures as a foundation concept in the composition of international instruments aimed at the solution of this problem, besides, the environmental causes that results in this category of forced displacement will be showed as well. Finally, the ability of recognition and protection of environmental refugees under international law will be analyzed. Within this perspective, there will be verified the adequacy of existing regulatory framework with the urgent need for protection of environmental refugees, besides the international responsibility that must be allocated to the States in the attempt of solving this problem. There will be brought, also, the limits and new alternatives that can make the environmental refugees really accepted in the international sphere.
