O Manejo Sustentável da Araucaria angustifolia e os gargalos da legislação ambiental para a preservação e manejo econômico do ecossistema

Abstract

O trabalho objetiva investigar de forma crítica o arranjo normativo e jurisprudencial aplicável à proteção e ao uso da Araucaria angustifolia nas esferas federal e subnacional, evidenciando as contradições interpretativas e os entraves burocráticos que obstaculizam o seu manejo florestal sustentável em Santa Catarina estruturada em cinco capítulos. Primeiramente introduz a problemática do impasse socioecológico e normativo da Floresta Ombrófila Mista (FOM), passando pela trajetória histórico-ecológica da espécie, desde o milenar manejo agroflorestal indígena até o desmatamento predatório no século XX e a importância atual da cadeia econômica do pinhão. A partir disso, debruça-se à legislação brasileira aplicável, destacando a dialética normativa entre a Lei da Mata Atlântica e o Novo Código Florestal e os pareceres federais sobre o tema para, após, discorrer sobre a análise da legislação catarinense, apontando os conflitos federativos, inconstitucionalidades e os severos gargalos operacionais no licenciamento perante o Instituto do Meio Ambiente (IMA/SC). Conclui-se que o atual modelo preservacionista, baseado estritamente em comando e controle, falhou e gerou uma "barreira psicológica" que induz à erradicação clandestina da espécie. Portanto, é urgente a transição para o Estado de Direito Ecológico, promovendo-se o manejo colaborativo desburocratizado, a silvicultura nativa e o Pagamento por Serviços Ambientais (PSA), a fim de conciliar a conservação biológica com o desenvolvimento socioeconômico.

This paper aims to critically investigate the normative and jurisprudential framework applicable to the protection and use of Araucaria angustifolia at the federal and subnational levels, highlighting the interpretative contradictions and bureaucratic obstacles that hinder its sustainable forest management in Santa Catarina, structured into five chapters. First, it introduces the problem of the socio-ecological and normative impasse of the Araucaria forest (FOM), covering the historical-ecological trajectory of the species, from the millennial indigenous agroforestry management to the predatory deforestation in the 20th century and the current importance of the pine nut (pinhão) economic chain. Based on this, it delves into the applicable Brazilian legislation, highlighting the normative dialectics between the Atlantic Forest Law and the New Forest Code, as well as the federal opinions on the subject. Subsequently, it discusses the analysis of Santa Catarina's legislation, pointing out federative conflicts, unconstitutionalities, and severe operational bottlenecks in the licensing process before the Environment Institute (IMA/SC). It is concluded that the current preservationist model, strictly based on command and control, has failed and generated a "psychological barrier" that induces the clandestine eradication of the species. Therefore, a transition to the Ecological Rule of Law is urgent, promoting unbureaucratized collaborative management, native silviculture, and Payment for Environmental Services (PSA), in order to reconcile biological conservation with socioeconomic development.
