“SE ESSA RUA FOSSE NOSSA”: ESPAÇO PÚBLICO, CULTURA URBANA E DIREITO À CIDADE NA GESTÃO MUNICIPAL DE FLORIANÓPOLIS (2024–2026)

Abstract

A pesquisa analisa a normatização do uso do espaço público e seus impactos sobre a cultura de rua e a vida noturna em Florianópolis, à luz do direito à cidade e da produção do espaço urbano. Adota abordagem qualitativa, com análise crítica dos decretos municipais editados entre 2024 e 2025, buscando compreender seus fundamentos jurídicos e seus efeitos sobre as manifestações culturais urbanas. Examina as relações entre produção do espaço urbano, cultura popular e poder de polícia administrativa, identificando os impactos dessas normas sobre a ocupação do espaço público e as estratégias de permanência e resistência desenvolvidas por coletivos culturais. Conclui que os decretos municipais extrapolam os limites do poder regulamentar, incorrendo em inconstitucionalidade formal e material, além de ilegalidade, ao operarem como instrumentos de controle seletivo que restringem manifestações culturais populares e tensionam direitos fundamentais. Destaca, por fim, a persistência de práticas de resistência que reafirmam o espaço público como lugar de encontro, cultura, pertencimento e exercício do direito à cidade.

This study analyzes the regulation of public space use and its impacts on street culture and nightlife in Florianópolis, in light of the right to the city and the production of urban space. It adopts a qualitative approach based on a critical analysis of municipal decrees issued between 2024 and 2025, seeking to examine their legal foundations and their effects on urban cultural expressions. The study explores the relationship between the production of urban space, popular culture, and administrative police power, identifying the impacts of these regulations on the occupation of public space and on the strategies of permanence and resistance developed by cultural collectives. It concludes that the municipal decrees exceed the limits of regulatory authority, resulting in formal and substantive unconstitutionality, as well as illegality, by operating as instruments of selective control that restrict popular cultural expressions and place undue constraints on fundamental rights. Finally, the study highlights the persistence of resistance practices that reaffirm public space as a place of encounter, culture, belonging, and the exercise of the right to the city.
