A presente pesquisa se dedica a investigar o caráter soteriológico do fenômeno jurídico-capitalista, partindo da hipótese de que o direito reelabora e seculariza arranjos simbólicos oriundos da tradição religiosa, em especial a cristã, passando a operar como mediador de promessas de salvação no contexto da realidade e sociabilidade capitalista. O estudo tem por objetivo examinar de que maneira a promessa salvífica, compreendida como categoria fundante da experiência religiosa, é deslocada para o campo jurídico e, posteriormente, articulada à lógica do capital, assumindo novas formas de legitimação da ordem social. Para tanto, adota-se metodologia de natureza teórica, desenvolvida por meio de revisão bibliográfica interdisciplinar, com abordagem crítica, materialista e historicista, mobilizando contribuições da teologia, da sociologia, da filosofia da religião e da teoria crítica do direito. Inicialmente, a pesquisa analisa a salvação dentro do pensamento religioso, a partir do cristianismo primitivo, lido a partir da perspectiva histórico-materialista de Friedrich Engels, a fim de demonstrar como a promessa redentiva se relaciona à experiência da opressão e à constituição de formas abstratas de pertencimento. Em seguida, examina o processo de secularização dos símbolos religiosos e a transfiguração de elementos teológicos em categorias jurídicas, destacando a formação de uma crença normativa sustentada por mitos, rituais, promessas e expectativas de ordem. Por fim, investiga o vínculo entre forma jurídica e forma mercadoria a partir da crítica pachukaniana do direito, articulando-a à tese do capitalismo como religião, para sustentar que o direito, no mundo da mercadoria, administra simbolicamente expectativas de redenção associadas ao modo de produção vigente. Ao fim, conclui-se que o fenômeno jurídico-capitalista atua na mediação soteriológica entre a fé religiosa e a fé econômica, manejando antigas promessas de salvação sob linguagem jurídica. Com isso, a pesquisa evidencia a necessidade de submeter à ótica crítica a suposta neutralidade do direito, expondo, assim, as continuidades que conectam à tradição religiosa à reprodução das formas de dominação do capitalismo. This research investigates the soteriological character of the juridical-capitalist phenomenon, based on the hypothesis that law reworks and secularizes symbolic arrangements derived from the religious tradition, especially the Christian one, and thus comes to operate as a mediator of promises of salvation within the context of capitalist reality and sociability. The study aims to examine how the salvific promise, understood as a founding category of religious experience, is displaced into the juridical sphere and subsequently articulated with the logic of capital, thereby assuming new forms of legitimizing the social order. To this end, the research adopts a theoretical methodology developed through an interdisciplinary bibliographical review, grounded in a critical, materialist, and historicist approach, drawing on contributions from theology, sociology, philosophy of religion, and critical legal theory. Initially, the study analyzes salvation within religious thought, focusing on early Christianity as interpreted through Friedrich Engels’s historical-materialist perspective, in order to demonstrate how the redemptive promise relates to the experience of oppression and to the constitution of abstract forms of belonging. It then examines the process of secularization of religious symbols and the transfiguration of theological elements into juridical categories, highlighting the formation of a normative belief sustained by myths, rituals, promises, and expectations of order. Finally, it investigates the relationship between the juridical form and the commodity form through Pachukanis’s critique of law, articulating it with the thesis of capitalism as religion in order to argue that, in the world of commodities, law symbolically administers expectations of redemption associated with the prevailing mode of production. In conclusion, the research argues that the juridical-capitalist phenomenon acts as a soteriological mediation between religious faith and economic faith, handling ancient promises of salvation through juridical language. In doing so, it demonstrates the need to critically examine the alleged neutrality of law, exposing the continuities that connect religious tradition to the reproduction of capitalist forms of domination. |
