Internet e direito administrativo: aspectos históricos e desafios normativos atuais

Abstract

O presente trabalho analisa o tratamento jurídico conferido à Internet e aos seus provedores no Brasil, sob a ótica do Direito Administrativo, investigando a adequação do atual arranjo regulatório diante dos desafios da sociedade em rede. O objetivo central é compreender como o ordenamento jurídico nacional buscou enquadrar o setor da informática dentro de parâmetros preexistentes e identificar as assimetrias em relação ao setor de telecomunicações. Para tanto, utiliza-se o método de abordagem dedutivo, fundamentado em pesquisa bibliográfica e análise documental de marcos regulatórios como a Lei Geral de Telecomunicações e o Marco Civil da Internet. A pesquisa percorre a trajetória histórica do desenvolvimento da rede, desde seus primórdios militares até a consolidação da Internet comercial no Brasil e o processo de privatização ocorrido na década de 1990. Examina-se a configuração estrutural da rede, diferenciando os papéis dos provedores de acesso, serviço e conteúdo, e analisa-se a classificação da Internet como Serviço de Valor Adicionado (SVA), o que a afasta do regime de serviço público privativo aplicável às telecomunicações. Observam-se os impactos sociais decorrentes da invisibilidade digital e a necessidade de políticas públicas de inclusão, como o Governo Digital. Analisa-se, ainda, a responsabilidade civil das plataformas e das Big Techs, destacando o recente entendimento do Supremo Tribunal Federal sobre a moderação de conteúdos ilícitos. Conclui-se pela existência de um vazio normativo no tratamento dos SVAs e pela insuficiência da segregação entre os regimes de acesso e conteúdo para regular a soberania privada das grandes corporações. Defende-se a aplicação do constitucionalismo digital e a adoção de posturas administrativas proativas, como o sandbox regulatório, visando equilibrar a inovação tecnológica com a proteção de direitos fundamentais e o fortalecimento da democracia contemporânea.

This study analyzes the legal treatment granted to the Internet and its providers in Brazil from the perspective of Administrative Law, investigating the adequacy of the current regulatory arrangement in the face of the challenges of the network society. The central objective is to understand how the national legal system sought to frame the information technology sector within pre-existing parameters and to identify asymmetries in relation to the telecommunications sector. To this end, a deductive approach method is used, based on bibliographic research and documentary analysis of regulatory frameworks such as the General Telecommunications Law and the Brazilian Civil Rights Framework for the Internet. The research covers the historical trajectory of the network's development, from its military beginnings to the consolidation of the commercial Internet in Brazil and the privatization process that occurred in the 1990s. The structural configuration of the network is examined, differentiating the roles of access, service, and content providers, and the classification of the Internet as a Value-Added Service (VAS) is analyzed, which distances it from the private public service regime applicable to telecommunications. Social impacts resulting from digital invisibility and the need for public inclusion policies, such as Digital Government, are observed. Furthermore, the civil liability of platforms and Big Techs is analyzed, highlighting the recent understanding of the Supreme Federal Court on the moderation of illicit content. The study concludes that there is a normative void in the treatment of VAS and that the segregation between access and content regimes is insufficient to regulate the private sovereignty of large corporations. It advocates for the application of digital constitutionalism and the adoption of proactive administrative stances, such as the regulatory sandbox, aiming to balance technological innovation with the protection of fundamental rights and the strengthening of contemporary democracy.
