Impacto do linguajar técnico-jurídico no acesso à justiça: desafios e estratégias para a superação da barreira comunicacional

Abstract

A presente monografia tem como tema “O impacto do Linguajar Técnico-Jurídico no Acesso à Justiça: Desafios e Estratégias para a Superação da Barreira Comunicacional”. A partir da pergunta norteadora “Como o uso do linguajar técnico-jurídico influencia a acessibilidade e a efetividade do acesso à justiça, e quais estratégias estão sendo implementadas para mitigar essa barreira comunicacional?", o objetivo geral consiste em analisar o linguajar técnico-jurídico como instrumento de poder simbólico e de limitação comunicacional, incorporando as percepções da comunidade acadêmica sobre o fenômeno e refletindo criticamente sobre as estratégias institucionais voltadas à sua superação. Para atingir tal finalidade, o estudo: (i) delineia o fenômeno linguístico enquanto instrumento funcional de comunicação, orientada à finalidade do discurso e à relação entre emissor e receptor; (ii) analisa as origens, usos e mecanismos de perpetuação do juridiquês, evidenciando o seu afastamento da função comunicacional supramencionada; (iii) contextualiza o acesso à justiça à luz da teoria do poder simbólico, destacando a consolidação do juridiquês como entrave à justiça plena; (iv) verifica, por meio da aplicação de questionários à comunidade acadêmica, as percepções gerais sobre o uso do juridiquês e suas implicações na compreensão do sistema de justiça; e (v) analisa as estratégias institucionais voltadas à simplificação da linguagem jurídica, com destaque para o Pacto Nacional pela Linguagem Simples. Concluiu-se, ao final dos trabalhos, que o uso excessivo da linguagem técnico-jurídica se configura como uma significativa barreira comunicacional no que tange à efetividade do acesso à justiça, sobretudo entre os grupos mais vulneráveis, sendo imprescindível o reconhecimento de sua existência e a adoção de estratégias concretas voltadas à promoção da linguagem simples e da democratização do discurso jurídico no Brasil.

This thesis examines “The Impact of Technical Legal Language on Access to Justice: Challenges and Strategies to Overcome Communicational Barriers.” Guided by the question, “How does the use of technical legal language influence accessibility and the effectiveness of access to justice, and what strategies are being implemented to mitigate this communicational barrier?”, the general objective is to analyze technical legal language as an instrument of symbolic power and communicative limitation, incorporating the perceptions of the academic community regarding this phenomenon and critically reflecting on institutional strategies designed to overcome it. To achieve this purpose, the study: (i) outlines the linguistic phenomenon as a functional instrument of communication, oriented toward the purpose of discourse and the relationship between speaker and audience; (ii) examines the origins, uses, and mechanisms of perpetuation of legal jargon (‘legalese’), highlighting its departure from the communicative function mentioned above; (iii) contextualizes access to justice in light of the theory of symbolic power, emphasizing the consolidation of legalese as an obstacle to full justice; (iv) evaluates, through questionnaires administered to the academic community, general perceptions regarding the use of legal jargon and its implications for understanding the justice system; and (v) analyzes institutional strategies aimed at simplifying legal language, with particular attention to the National Pact for Plain Language. The study concludes that the excessive use of technical legal language constitutes a significant communicational barrier to the effectiveness of access to justice, especially among vulnerable groups. Recognizing this barrier and adopting concrete strategies to promote plain language and democratize legal discourse in Brazil is therefore essential.
