O abandono familiar de mulheres encarceradas na Região Sul

Abstract

O presente trabalho tem como objetivo analisar o abandono das mulheres encarceradas na Região Sul do país e compreender os motivos pelos quais esse problema se verifica. De início, a revisão bibliográfica foi utilizada para compreender o contexto em que está inserida a mulher que é selecionada pelo sistema punitivo brasileiro, antes e depois da prisão. Em um segundo momento, utilizou-se o método quantitativo, a partir da pesquisa eletrônica realizada nos sites dos Tribunais de Justiça dos estados da Região Sul do país e, principalmente, a partir dos dados fornecidos pelos referidos estados que foram solicitados por meio da Lei de Acesso à Informação (Lei n. 12.527/2011). Por fim, os dados coletados foram comparados com a revisão bibliográfica de pesquisas empíricas de diferentes estados brasileiros que tratam especificamente do abandono das mulheres encarceradas, realizadas por meio de entrevistas nas quais as detentas expressaram suas vivências e opiniões sobre o cárcere. O conjunto dessas análises possibilitou a construção da hipótese de que existe uma relação de continuidade: a violação de direitos das mulheres e a sua vulnerabilidade ocorrem antes mesmo do seu encarceramento, com o processo de empobrecimento de mulheres intensificado pela divisão sexual do trabalho e pela própria reconfiguração dos arranjos familiares, observado pelo aumento, nos últimos anos, dos lares chefiados por mulheres. Estes fatores se somam à negligência já antiga do sistema carcerário quanto às especificidades das mulheres encarceradas, ocasionando outras restrições de direitos nos quais se insere a garantia da convivência com os familiares

This paper has the object to analyze the abandonment of incarcerated women in southern Brazil and understand the reasons that led to this problem. Initially, a bibliographic research was performed to understand the context in which the incarcerated woman is inserted, before and after prison. In a second moment, the quantitative method is used, utilizing electronic research on the websites of the Courts of Justice of the states in the southern region of the country and, mainly, from the data provided by the states, which were requested through the Law of access to Information (Law No. 12,527 / 2011). Finally, the collected data were compared with a literature review of empirical research from different Brazilian states, which specifically deal with the abandonment of incarcerated women, who shared information and expressed their experiences and opinions about prison. These analyzes enabled the construction of the hypothesis that there is a continuity relationship: violations of women's rights and their vulnerability occur even before their incarceration, with the process of women's impoverishment intensified by the sexual division of labor and the reconfiguration of family arrangements, observed by the increase, in recent years, of households headed by women. These factors are added to the former neglect of the prison system in relation to the specificities of incarcerated women, causing other restrictions on rights that include a guarantee of coexistence with family members
