Abstract: Affiliated with the concentration area Law, Politics and Society and the research line Systems of Guarantees, Private Legal Relations and Proceduralities and to the Collective Project titled 'Das Processualidades' ['On Proceduralities']\" of the Graduate Program in Law of the Federal University of Santa Catarina, insofar as it relates the judicial protection against disinformation to access to justice and to the study of contemporary proceduralities, this work aims to analyze the suitability of structural litigation as a vehicle for claims relating to the legal consequences of disinformation in Brazil, as well as the procedural interconnections between this instrument and the problem of disinformation. The research adopts the deductive method, the monographic procedure and the bibliographical research technique, departing from three substantive-law premises (that disinformation and the act of disinforming constitute phenomena to be countered, that they find no shelter in the fundamental right to freedom of expression, and that the models of self-regulation and of judicial reserve must be combined through the structural avenue). The first three chapters set out the origins, the theoretical foundations and the procedure of structural litigation (as regards representation and participation, the framing of the object, the taking of evidence, the forms of dispute resolution and the enforcement of decisions), taking as reference illustrative examples from foreign and Brazilian courts and Bill No. 3 of 2025, currently pending in the Federal Senate. In the final chapter, the phenomenon is submitted to the test of the characteristics of the structural problem (multipolarity, complexity, prospectivity, broad radiation and the need for institutional reconstruction), leading to the conclusion that disinformation constitutes, in Brazil, a problem of this nature. The hypothesis formulated is answered in the affirmative, by proposing that structural litigation is a more suitable instrument than the traditional model of civil procedure for addressing disinformation, because it broadens the participation of multiple interested parties, reduces the silencing effect on speech, fosters inter-institutional dialogue, admits consensual and shared solutions, and accommodates open-ended and cyclical claims, compatible with the dynamic nature of the informational phenomenon. At the enforcement stage, drawing on the promotional function of law, the work proposes the use of procedural incentives (reward sanctions and nudges) and of support structures, oriented toward an ideal state of informational integrity. Whereas atomized treatment proves insufficient to confront the root of the problem, structural techniques bear upon the architecture and the incentives of the informational ecosystem, rather than upon the content of expressions, which allows for a deeper, more prospective and more effective approach without compromising freedom of expression.
