Por uma teoria praxeológica da justiça: uma reconstrução crítica da abordagem das capacidades

Abstract

A filosofia política contemporânea, marcadamente influenciada pelo institucionalismo transcendental, consolidou modelos de justiça cuja sofisticação formal contrasta com sua limitada capacidade de orientar o enfrentamento concreto das privações que assolam sociedades reais. A presente tese propõe, mediante reconstrução crítica da Abordagem das Capacidades (capabilities) 1 inaugurada por Amartya Sen, uma concepção original denominada teoria praxeológica da justiça, centrada na práxis transformadora, na materialidade das condições de existência e na avaliação comparativa de injustiças manifestas. O objetivo consiste em demonstrar que a articulação sistemática de três eixos interdependentes, o normativo?capacitarista, o epistemológico-pragmatista e o econômico-material, constitui uma alternativa coerente e operacionalizável ao paradigma da justiça ideal. A investigação adota uma metodologia eminentemente teórica, combinando reconstrução argumentativa, análise conceitual, estudo comparativo e revisão bibliográfica interdisciplinar. O percurso argumentativo desenvolve-se em três movimentos. O primeiro transforma a Abordagem das Capacidades de arcabouço avaliativo em genuína teoria da justiça com vocação praxeológica, priorizando a comparação entre estados sociais possíveis e o enfrentamento emergencial das privações concretas. O segundo ancora essa teoria no pragmatismo filosófico de Hilary Putnam e John Dewey, cuja dissolução da dicotomia fato-valor demonstra que a objetividade dos juízos normativos emerge do entrelaçamento constitutivo entre descrição e avaliação, sem recurso a entidades metafísicas; nesse movimento, a tese formula o conceito de mosaico axiológico multiforme de justificações, estrutura na qual diferentes dimensões da racionalidade prática convergem para fundamentar juízos éticos objetivos em um horizonte pós-metafísico. O terceiro movimento enfrenta a questão da materialidade da justiça, articulando a análise da dinâmica estrutural do capital com propostas de regulação democrática da riqueza e de renda básica incondicional, demonstrando a viabilidade econômica e institucional da expansão universal das capacidades. A investigação conclui que a convergência desses três pilares engendra uma teoria da justiça que se distingue por ser comparativa e não transcendental, centrada em realizações e não em arranjos institucionais, epistemologicamente sustentada por um falibilismo pragmático, materialmente ancorada nas condições econômicas de sua própria efetivação e emergencialmente orientada para a eliminação de injustiças que comprometem vidas humanas concretas. A originalidade reside na arquitetura teórica triádica que integra essas dimensões numa síntese até então inexplorada de modo articulado no debate filosófico sobre a justiça.

Abstract: Contemporary political philosophy, markedly influenced by transcendental institutionalism, has consolidated models of justice whose formal sophistication stands in contrast to their limited capacity to guide the concrete confrontation of the deprivations that afflict real societies. Through a critical reconstruction of the Capability Approach inaugurated by Amartya Sen, this thesis advances an original conception termed a praxeological theory of justice, one centred on transformative praxis, on the materiality of the conditions of existence, and on the comparative assessment of manifest injustices. Its aim is to demonstrate that the systematic articulation of three interdependent axes, namely the normative-capabilitarian, the epistemological?pragmatist, and the economic-material, constitutes a coherent and operationalizable alternative to the paradigm of ideal justice. The investigation adopts an eminently theoretical methodology, combining argumentative reconstruction, conceptual analysis, comparative study, and interdisciplinary literature review. The argument unfolds in three movements. The first transforms the Capability Approach from an evaluative framework into a genuine theory of justice with a praxeological vocation, prioritizing the comparison of possible social states and the urgent confrontation of concrete deprivations. The second anchors this theory in the philosophical pragmatism of Hilary Putnam and John Dewey, whose dissolution of the fact?value dichotomy demonstrates that the objectivity of normative judgements emerges from the constitutive entanglement of description and evaluation, with no recourse to metaphysical entities; in this movement, the thesis formulates the concept of a multiform axiological mosaic of justifications, a structure in which different dimensions of practical rationality converge to ground objective ethical judgements within a post-metaphysical horizon. The third movement confronts the question of the materiality of justice, articulating an analysis of the structural dynamics of capital with proposals for the democratic regulation of wealth and for an unconditional basic income, thereby demonstrating the economic and institutional feasibility of the universal expansion of capabilities. The investigation concludes that the convergence of these three pillars engenders a theory of justice distinguished by being comparative rather than transcendental, centred on realizations rather than on institutional arrangements, epistemologically sustained by a pragmatic fallibilism, materially anchored in the economic conditions of its own actualization, and urgently oriented towards the elimination of injustices that compromise concrete human lives. Its originality lies in the triadic theoretical architecture that integrates these dimensions into a synthesis which, in its articulated form, has hitherto remained unexplored within the philosophical debate on justice.
