Abstract: Nesta dissertação examina-se a temática do dano existencial decorrente do trabalho e a sua possível incidência entre profissionais do setor de enfermagem, uma categoria profissional fundamental para a manutenção dos serviços de saúde, majoritariamente feminina e frequentemente submetida a condições laborais adversas. Por dano existencial entende-se a lesão que compromete a liberdade de escolha do indivíduo e frustra o ?projeto de vida? e a ?vida de relações? construídas pelo/a trabalhador/a enquanto ser humano. Busca-se compreender como os processos laborais e as condições de trabalho, atravessados pelas configurações de classe, de gênero e raça, podem revelar dinâmicas que eventualmente ocasionam o dano existencial decorrente do trabalho. O conceito de qualidade de vida, cunhado pela Organização Mundial da Saúde (OMS), é mobilizado para compreender a percepção dos indivíduos sobre sua posição na vida dentro de um contexto cultural e social. No ambiente de trabalho, buscouse evidenciar como esta percepção é diretamente influenciada por fatores como sobrejornada, sobrecarga e precarização. Deste modo, a investigação quanto à incidência do dano existencial no contexto do setor da enfermagem mostra-se imprescindível para a compreensão dos aspectos subjetivos e estruturais das relações de trabalho no setor de enfermagem. Nesse sentido, identificou-se uma lacuna na literatura ao abordar o fenômeno do dano existencial a partir da Sociologia do Trabalho ou coordenando seus acúmulos com os do campo do Direito do Trabalho. A ausência de um diálogo mais aprofundado entre essas áreas, bem como a de pesquisas empíricas sobre o tema, limitam a compreensão da complexidade desse fenômeno ? sendo que estas lacunas que a presente pesquisa procura minimizar. O fato de que o trabalho na enfermagem seja majoritariamente exercido por mulheres, em sua maioria negras, torna-o importante ponto de observação das dinâmicas da divisão sexual e racial do trabalho, que direcionaram a análise também para os temas como a dupla jornada, a escassez do tempo de não trabalho, desvalorização profissional, sobrecarga física e emocional. A metodologia para alcançar os objetivos e explorar a problemática se situará numa abordagem qualitativa, com a realização de observações de processos de trabalho, entrevistas semiestruturadas e a análise de documentos, tais como: decisões judiciais sobre o tema, regulamentações trabalhistas em vigor desde a reforma de 2017 e específicas da categoria. Na construção da fundamentação teórica foram utilizados acúmulos do campo do direito, da sociologia do trabalho, da filosofia e estudos feministas e de gênero sobre trabalho, relevantes para o tema do dano existencial decorrente do trabalho os quais buscou-se coordenar sob uma perspectiva materialista interdisciplinar. Foram eleitos os seguintes procedimentos metodológicos: 1) Revisão bibliográfica; 2) pesquisa documental; 3) entrevistas qualitativas semiestruturadas. Objetivou-se identificar e analisar os parâmetros para delimitação e reconhecimento do fenômeno do dano existencial, bem como as situações e representações de profissionais do setor de enfermagem - sobre o trabalho que realizam, buscando identificar se e em que medida podem ser interpretadas como causadoras de dano existencial.Abstract: This dissertation examines the issue of existential damage arising from work and its possible incidence among professionals in the nursing sector, a professional category that is fundamental to the maintenance of health services, predominantly female, and frequently subjected to adverse working conditions. Existential damage is understood as an injury that compromises the individual?s freedom of choice and frustrates the ?life project? and the ?life of relationships? constructed by the worker as a human being. The study seeks to understand how labor processes and working conditions, intersected by configurations of class, gender, and race, may reveal dynamics that potentially give rise to work-related existential damage. The concept of quality of life, as defined by the World Health Organization (WHO), is mobilized to understand individuals? perceptions of their position in life within a cultural and social context. In the work environment, the analysis highlights how this perception is directly influenced by factors such as extended working hours, work overload, and precarization. Thus, investigating the incidence of existential damage in the context of the nursing sector proves essential for understanding both the subjective and structural dimensions of labor relations in this field. In this regard, a gap was identified in the literature concerning the treatment of existential damage from the perspective of the Sociology of Work or through the articulation of its theoretical contributions with those of Labor Law. The lack of a more in-depth dialogue between these areas, as well as the scarcity of empirical research on the subject, limits the understanding of the complexity of this phenomenon?gaps that the present research seeks to mitigate. The fact that nursing work is predominantly performed by women, most of whom are Black, makes it a significant point of observation for the dynamics of the sexual and racial division of labor. This reality also guided the analysis toward themes such as the double workday, scarcity of non-working time, professional devaluation, and physical and emotional overload. The methodology adopted to achieve the research objectives and explore the proposed problem is qualitative in nature, involving observations of work processes, semi-structured interviews, and document analysis, including judicial decisions on the subject, labor regulations in force since the 2017 labor reform, and regulations specific to the nursing category. The theoretical framework draws on contributions from the fields of law, sociology of work, philosophy, and feminist and gender studies on labor, all coordinated under an interdisciplinary materialist perspective. The following methodological procedures were employed: (1) literature review; (2) documentary research; and (3) qualitative semi-structured interviews. The study aimed to identify and analyze the parameters for delimiting and recognizing the phenomenon of existential damage, as well as the situations and representations of nursing professionals regarding the work they perform, seeking to identify whether?and to what extent?these can be interpreted as causing existential damage.
