Vestindo a pele dos leões: democracia e supremacia judicial no pensamento político de Luís Roberto Barroso

Abstract

Este trabalho analisa o pensamento político-constitucional de Luís Roberto Barroso. Mapeando a rede de crenças do autor e colocando-a em seu contexto de formação e desenvolvimento, a tese busca compreender como Barroso justifica o empoderamento do poder judiciário e do Supremo Tribunal Federal e qual o papel que dá para eles na democracia brasileira. O estudo busca contribuir para a compreensão de aspectos ideológicos do rearranjo institucional dos três poderes na Nova República. Analisa a produção doutrinária e acadêmica de Barroso, bem como sua atuação como ministro. Conclui que o seu pensamento possui fundamentos teórico-conceituais (o neoconstitucionalismo, a nova hermenêutica e o pós-positivismo, associados à teoria política contemporânea) e histórico-sociológicos (a tradição americanista do diagnóstico do atraso) que legitimam a atuação ativista do judiciário e do STF e informam o papel que o autor dá às instituições.

Abstract: This work analyzes the political-constitutional thought of Luís Roberto Barroso. Mapping the author's web of beliefs and placing them within the context of their formation and development, the thesis seeks to understand how Barroso justifies the empowerment of the judiciary and the Supreme Federal Court and the role he assigns to them in Brazilian democracy. The study seeks to contribute to the understanding of ideological aspects of the institutional rearrangement of the three branches of government in the New Republic. It analyzes Barroso's doctrinal and academic production, as well as his work as a justice. It concludes that his thought has theoretical-conceptual foundations (neoconstitutionalism, new hermeneutics and post-positivism, associated with contemporary political theory) and historical-sociological foundations (the americanist tradition of diagnosing backwardness) that legitimize the activist posture of the judiciary and the Supreme Federal Court and inform the role the author assigns to these institutions.
