dc.description.abstract Há muito, a extrafiscalidade orienta parte relevante da tributação sobre o consumo no Brasil, sobretudo por meio de incentivos fiscais concedidos pelos entes federativos. A EC 132/2023, contudo, pode alterar profundamente esse cenário ao instituir o IBS e a CBS como tributos informados pelo princípio da neutralidade, redesenhando os limites de atuação extrafiscal. Este trabalho analisa como a reforma tributária redefine tais limites. Para isso, examina-se, por meio da análise normativa à luz da doutrina especializada, a evolução doutrinária da extrafiscalidade, os vetores constitucionais do novo modelo e os instrumentos extrafiscais previstos pela EC 132/2023, especialmente o Imposto Seletivo, as imunidades, os regimes diferenciados e favorecidos de IBS e CBS e o cashback. Conclui-se que a EC 132/2023 não elimina a extrafiscalidade, mas a restringe a hipóteses constitucionais específicas, conferindo ao Imposto Seletivo o papel central na indução de comportamentos econômicos e ao cashback a função de mitigar a regressividade da matriz tributária brasileira. pt_BR
dc.description.abstract For many years, extrafiscality has guided a significant portion of consumption taxation in Brazil, especially through tax incentives granted by subnational entities. Constitutional Amendment n. 132/2023, however, may profoundly alter this landscape by establishing the IBS and the CBS as taxes informed by the principle of neutrality, thereby redefining the limits of extrafiscal action. Through normative analysis in light of specialized legal scholarship, this study examines how the current reform reshapes such limits. To this end, it analyzes the doctrinal evolution of extrafiscality, the constitutional vectors of the new model, and the extrafiscal instruments provided by EC 132/2023 - particularly the Selective Tax, the immunities, the differentiated and favored regimes of IBS and CBS, and the cashback mechanism. The study concludes that EC 132/2023 does not eliminate extrafiscality, but restricts it to specific constitutional hypotheses, assigning to the Selective Tax a central role in inducing economic behavior and to the cashback mechanism the function of mitigating the regressivity of the Brazilian tax system on consumption. pt_BR
