O presente trabalho tem por objetivo analisar o caso al-Mahdi, julgado pelo Tribunal
Penal Internacional, em que, pela primeira vez, condenou-se, exclusivamente, a
destruição intencional de monumentos históricos e religiosos como crime de guerra.
O problema da pesquisa reside nos termos da sentença e nos fundamentos da
condenação, que, conjuntamente com uma análise do Direito Internacional
adequado, permite perceber elementos de tradição jurídica sob uma perspectiva
histórica e suas consequências práticas. Para tanto, fez-se recurso à metodologia de
Estudo de Caso, cotejando-se doutrina e literatura apropriadas com informações
objetivas pertinentes para refletir e tecer considerações sobre o julgado. Apoia-se,
portanto, no estudo e exame da legislação e jurisprudência relevantes, assim como
no levantamento bibliográfico e factual para a compreensão e análise do julgamento.
A escolha do tema justifica-se pela urgência e relevância que o patrimônio cultural
alcançou entre o final do século XX e as primeiras décadas do XXI, tornando-o
incontornável para o debate público e, consequentemente, para o Direito. A presente
pesquisa apresenta-se em quatro capítulos. No primeiro, recompõe-se o contexto do
conflito em que se originou o processo julgado pelo Tribunal, assim como seus
aspectos gerais, a descrição dos ataques executados por al-Mahdi e características
históricas a geográficas do país - com ênfase especial aos monumentos históricos e
religiosos da cidade de Tombuctu. No segundo, aborda-se tanto a construção
histórica e jurídica do Tribunal Penal Internacional, seu funcionamento e casos por
ele analisados quanto o crime de destruição intencional ao patrimônio cultural em
perspectiva histórica. O terceiro capítulo propõe-se a analisar o processo
propriamente, desde as investigações realizadas pela Procuradoria do Tribunal até a
Câmara de Apelações, aprofundando-se nos termos da condenação, as reparações
às vítimas, recursos e demais procedimentos processuais. Conclui-se o trabalho
com uma síntese das informações trazidas no corpo da obra relacionadas às
discussões literárias sobre o caso. Em primeiro lugar, faz-se ressalvas quanto ao
mecanismo de autodenúncia previsto no art. 14 do Estatuto de Roma, que pode ser
instrumentalizado por governos em crise para perseguir adversários domésticos. Em
seguida, podera-se a efetiva capacidade de restituição do dano causado, tendo em
consideração a sua insubstituibilidade. Por fim, quanto aos termos da sentença, a
fundamentação do julgado alterna entre uma abordagem civilista sobre o patrimônio
cultural, influenciado por instrumentos jurídicos de common law, e a chamada
“justificativa do uso civil”, segundo a qual o patrimônio cultural edificado é um meio
para a proteção dos civis em conflitos armados. Em ambos os casos, portanto, o
patrimônio cultural não se constitui como um bem jurídico autônomo, protegido de
modo especial, levando em consideração o seu valor intrínseco. Sugere-se, enfim, a
adoção complementar de tratados internacionais cuja proteção é mais específica. |

This paper aims to analyze the al-Mahdi case, judged by the International Criminal
Court, in which, for the first time, the intentional destruction of historical and religious
monuments was exclusively condemned as a war crime. The research problem lies
in the terms of the sentence and in the grounds for the conviction, which, together
with an analysis of the appropriate International Law, allows us to perceive elements
of legal tradition from a historical perspective and their practical consequences. To
this end, the Case Study methodology was used, comparing appropriate doctrine and
literature with relevant objective information to reflect on and offer considerations
regarding the judgment. It therefore relies on the study and examination of relevant
legislation and jurisprudence, as well as on bibliographic and factual research for the
understanding and analysis of the judgment. The choice of this theme is justified by
the urgency and relevance that cultural heritage has achieved between the end of the
20th century and the first decades of the 21st, making it unavoidable for public
debate and, consequently, for the field of Law. This research is presented in four
chapters. The first chapter reconstructs the context of the conflict that originated the
case judged by the Court, as well as its general aspects, the description of the
attacks carried out by al-Mahdi, and the historical and geographical characteristics of
the country – with special emphasis on the historical and religious monuments of the
city of Timbuktu. The second chapter addresses both the historical and legal
construction of the International Criminal Court, its functioning and cases analyzed by
it, as well as the crime of intentional destruction of cultural heritage from a historical
perspective. The third chapter proposes to analyze the process itself, from the
investigations carried out by the Office of the Prosecutor to the Appeals Chamber,
delving into the terms of the conviction, reparations to the victims, appeals, and other
procedural steps. The work concludes with a synthesis of the information presented
in the body of the work related to literary discussions about the case. First,
reservations are made regarding the self-referring mechanism foreseen in Article 14
of the Rome Statute, which can be instrumentalized by governments in crisis to
persecute domestic adversaries. Second, the effective capacity for restitution of the
damage caused must be considered, taking into account its irreplaceability. Finally,
regarding the terms of the judgment, the reasoning alternates between a civil law
approach to cultural heritage, influenced by common law legal instruments, and the
so-called "civilian-use rationale," according to which cultural heritage monuments are
a means for the protection of civilians in armed conflicts. In both cases, therefore,
cultural heritage does not constitute an independent legal asset, protected in a
special way, taking into account its intrinsic value. Finally, the complementary
adoption of international treaties with more specific protection is suggested. |

Cet article analyse l'affaire al-Mahdi, jugée par la Cour Pénale Internationale, dans
laquelle, pour la première fois, la destruction intentionnelle de monuments
historiques et religieux a été exclusivement condamnée comme un crime de guerre.
La problématique de la recherche réside dans les termes de la sentence et dans les
fondements de la condamnation, qui, conjugués à une analyse du Droit International
applicable, permettent d'appréhender les éléments de la tradition juridique dans une
perspective historique et d'en saisir les conséquences pratiques. À cette fin, la
méthodologie de l'étude de cas a été utilisée, comparant la doctrine et la littérature
appropriées avec des informations objectives pertinentes afin de réfléchir et de
formuler des considérations concernant le jugement. Elle s'appuie donc sur l'étude et
l'examen de la législation et de la jurisprudence pertinentes, ainsi que sur des
recherches bibliographiques et factuelles pour la compréhension et l'analyse du
jugement. Le choix de ce thème se justifie par l’urgence et la pertinence qu’ont
acquises le patrimoine culturel entre la fin du XXe siècle et les premières décennies
du XXIe, le rendant incontournable dans le débat public et, par conséquent, dans le
domaine du Droit. Cette recherche est présentée en quatre chapitres. Le premier
chapitre retrace le contexte du conflit à l'origine de l'affaire jugée par la Cour, en
présentant ses aspects généraux, la description des attaques perpétrées par
al-Mahdi et les caractéristiques historiques et géographiques du pays, notamment
les monuments historiques et religieux de la ville de Tombouctou. Le deuxième
chapitre aborde la construction historique et juridique de la Cour Pénale
Internationale, son fonctionnement et les affaires qu'elle a analysées, ainsi que le
crime de destruction intentionnelle du patrimoine culturel dans une perspective
historique. Le troisième chapitre propose d'analyser le processus lui-même, depuis
les enquêtes menées par le Bureau du Procureur de la Cour jusqu'à la Chambre
d'Appel, en examinant les conditions de la condamnation, les réparations aux
victimes, les appels et les autres étapes procédurales. L'ouvrage se conclut par une
synthèse des informations présentées, mises en relation avec les analyses littéraires
de l'affaire. Premièrement, des réserves sont émises quant au mécanisme
d’auto-renvoi prévu à l’article 14 du Statut de Rome, susceptible d’être
instrumentalisé par des gouvernements en crise pour persécuter leurs adversaires
politiques. Deuxièmement, la capacité effective de réparation du préjudice causé doit
être examinée, compte tenu de son caractère irremplaçable. Enfin, concernant les
termes de l’arrêt, le raisonnement oscille entre une approche de droit civil du
patrimoine culturel, influencée par la common law, et le «civilian-use rationale»,
selon laquelle les monuments du patrimoine culturel constituent un moyen de
protection des civils dans les conflits armés. Dans les deux cas, le patrimoine culturel
ne constitue donc pas un actif juridique autonome, protégé d'une manière
particulière, compte tenu de sa valeur intrinsèque. Enfin, l’adoption complémentaire
de traités internationaux offrant une protection plus spécifique est préconisée. |
