O trabalho analisa as repercussões jurídicas e sociais da superexposição da imagem de
crianças e adolescentes no ambiente virtual, utilizando o referencial teórico da Sociedade do
Espetáculo, de Guy Debord, e da Violência Simbólica, de Pierre Bourdieu. Busca-se examinar
a transformação do infante em objeto de consumo e a negligência aos direitos fundamentais à
imagem, à honra e à privacidade em prol do engajamento digital. Como objeto de análise,
utiliza-se o fenômeno da "infância-espetáculo", manifestado através da prática do sharenting e
da criação de influenciadores mirins, bem como a resposta estatal consubstanciada na recente
Lei n. 15.211/2025. Com isso, visa-se avaliar como a lógica de espetacularização impede o
pleno desenvolvimento da criança. O problema da pesquisa cinge-se em aferir como a
superexposição infantil, aliada à exploração econômica e à objetificação dos corpos, impacta
a garantia efetiva dos direitos fundamentais da criança, e de que modo o novo Estatuto Digital
da Criança e do Adolescente apresenta uma barreira efetiva a essa problemática. Como
objetivos específicos, o estudo busca: a) traçar um panorama geral da tutela jurídica da
criança dentro do ordenamento brasileiro; b) examinar, sob uma perspectiva teórica, como a
superexposição afeta o infante; e c) analisar se a Lei n. 15.211/2025 oferece o suporte
necessário para proteger a criança da exposição indevida nas mídias digitais. Adota-se o
método dedutivo, e a pesquisa utiliza de análise de literatura e legislação sobre a matéria para,
subsequentemente, aplicar as bases teóricas à interpretação do novo diploma legal. Como
resultado, conclui-se que a nova Lei representa um avanço indispensável ao regular a
exploração econômica e impor deveres de segurança às plataformas, mas ainda revela-se
insuficiente para combater a superexposição cotidiana. |

This paper analyzes the legal and social impact of the overexposure of children and
adolescents’ images in the virtual environment, using the theoretical frameworks of Guy
Debord’s The Society of the Spectacle and Pierre Bourdieu’s concept of symbolic violence.
The main goal is to examine the transformation of the child into a commodity and the neglect
of fundamental rights regarding image, honor, and privacy for the sake of digital engagement.
The study focuses on the phenomenon of the spectacularization of childhood, seen in
sharenting practices and the rise of child influencers, as well as the state response embodied
in the recent Digital Statute of the Child and Adolescent. Therefore, the aim is to evaluate
how the logic of spectacularization hinders the child's full development. The research problem
centers on assessing how the overexposure of children, coupled with economic exploitation
and commodification, impacts the effective guarantee of the child's fundamental rights, and
whether Law No. 15.211/2025 provides an effective safeguard against this problem.
Specifically, the research aims to: a) outline the legal protection of children within the
Brazilian legal system; b) examine, from a theoretical perspective, how overexposure affects
the child; and c) analyze whether Law No. 15.211/2025 offers the necessary support to protect
the child from undue exposure on social media. The study adopts the deductive method, using
literature and legislation analysis to apply theoretical foundations to the interpretation of the
new law. The conclusion is that, while Law represents a crucial advancement by regulating
economic exploitation and imposing safety duties on platforms, it remains insufficient to
combat daily overexposure. |
