O relatório de investigação de acidentes aeronáuticos emitido pelo sistema de investigação e prevenção de acidentes aeronáuticos

Abstract

Este trabalho tem como objetivo apresentar o conflito existente e gerado pela exigência do Poder Judiciário em utilizar o Relatório de Investigação de Acidente Aeronáutico na instrução criminal, com o intuito de estabelecer culpa e responsabilidade. Os capítulos irão discorrer sobre a atividade aérea, seu histórico, sua importância e contexto socioeconômico, sua ligação com a doutrina e filosofia da segurança de vôo. Tratarse-á sobre a legislação nacional e internacional pertinente e, ao final, sobre as implicações do Relatório de Acidente Aeronáutico no processo judicial. Será traçada uma visão analítica sobre as soluções que poderiam minimizar o conflito e sobre a busca de uma cooperação mútua entre o Sistema de Investigação Prevenção de Acidentes Aeronáuticos e o Poder Judiciário.

This work has the goal to present the extant conflict generated by the demand of judicial power in utilizing the aeronautical accident investigation report in criminal instruction, with the intention of stablishing guilt and responsability. The chapters will explain aerial activity, it's history and inportance, it's social economic setting and it's connection to the doctrine of flight safety. The chapters will deal with national and international suitable legislation, at last, it will explain about the troubles of the aeronautical accident report in judicial action. An analitycal vision will be traced about the solutions that can minimize the conflict, also about the seach for mutual cooperation between the investigation sistem of preventive aeronautical accidents and the judicial power.
