Acesso à justiça: análise da regionalização e especialização de competências na Justiça Federal de Santa Catarina no período 2018/2023 sob os enfoques da gestão e da eficiência

Abstract

O Poder Judiciário tem buscado acompanhar as transformações sociais e econômicas para prestar uma jurisdição eficiente e eficaz, propiciando o acesso à justiça a todos os cidadãos, o que pode ser alcançado com a melhoria da eficiência organizacional. O trabalho, com o objetivo geral de analisar se houve avanço no acesso à justiça e na eficiência do Poder Judiciário, considera especificamente o cenário da Justiça Federal de Santa Catarina no período 2018/2023, a partir da utilização de novas ferramentas. A hipótese principal é que a gestão e a tecnologia podem incrementar o acesso à justiça e a eficiência na prestação jurisdicional. Para a realização do objetivo, a pesquisa se desenvolve em três capítulos. No primeiro capítulo, são abordados o Acesso à Justiça a partir da história da humanidade e sob a perspectiva dos direitos fundamentais, ressaltando-se a importância do Acesso à Justiça como catalisador de desenvolvimento social. O segundo capítulo aborda a origem e o desenvolvimento da Justiça Federal no Brasil e na 4ª Região, lançando as bases para apresentar o projeto desenvolvido pela Corregedoria do TRF4 que almejou melhorar a prestação jurisdicional aos catarinenses. No terceiro capítulo, desenvolve-se o estudo do caso a partir dos dados coletados em diferentes relatórios das atividades jurisdicionais. A pesquisa adotou o método de abordagem dedutivo e a técnica de pesquisa bibliográfica. Para o levantamento e análise dos números mencionados, o estudo utilizará os métodos de procedimento comparativo e o estatístico. Como resultado na pesquisa, apontouse possibilidade concreta de melhoria do acesso à justiça e da eficiência do Poder Judiciário, constatando que a inovação tecnológica para promover a equalização das cargas de trabalho das unidades judiciárias ensejou o melhor aproveitamento dos recursos humanos e materiais já existentes. A quantidade de processos julgados no período demonstra ainda que o projeto surtiu efeitos positivos na eficiência da prestação jurisdicional, com resultados limitados pela crescente distribuição processual. Com o trabalho, ainda descortinaram novos campos a serem pesquisados, com maior interdisciplinaridade entre a Ciência Jurídica e, em especial a Economia, a Administração e a Sociologia.

Abstract: The Judiciary has sought to keep up with social and economic transformations in order to provide an efficient and effective jurisdiction, providing access to justice to all citizens, which can be achieved by improving organizational efficiency. The work, with the general objective of analyzing whether there has been progress in access to justice and in the efficiency of the Judiciary, specifically considers the scenario of the Federal Justice of Santa Catarina in the period 2018/2023, based on the use of new tools. The main hypothesis is that management and technology can increase access to justice and efficiency in judicial provision. To achieve the objective, the research is developed in three chapters. In the first chapter, Access to Justice is addressed from the history of humanity and from the perspective of fundamental rights, emphasizing the importance of Access to Justice as a catalyst for social development. The second chapter addresses the origin and development of the Federal Justice in Brazil and in the 4th Region, laying the foundations to present the project developed by the TRF4 Internal Affairs Department that aimed to improve the jurisdictional provision to the people of Santa Catarina. In the third chapter, the case study is developed based on the data collected in different reports of jurisdictional activities. The research adopted the deductive approach method and the bibliographic research technique. For the survey and analysis of the mentioned figures, the study will use the methods of comparative procedure and statistics. As a result of the research, it was pointed out a concrete possibility of improving access to justice and the efficiency of the Judiciary, noting that technological innovation to promote the equalization of the workloads of the judicial units has led to the best use of existing human and material resources. The number of cases judged in the period also shows that the project had positive effects on the efficiency of judicial provision, with results limited by the growing procedural distribution. With the work, they also revealed new fields to be researched, with greater interdisciplinarity between Legal Science and, in particular, Economics, Administration and Sociology.
