À sombra da lei: relações de poder entre o sujeito refugiado por motivos de orientação sexual e identidade de gênero e o Estado

Abstract

Este trabalho se dedicou a analisar as relações de biopoder que se dão entre a pessoa refugiada dissidente e o Estado no processo de solicitação de refúgio, por meio da análise dos documentos de referência (legais e pedagógicos) que materializam os discursos sobre refúgio para pessoas de gênero dissidente. Para tanto, atentando para o fato de que os discursos sobre refúgio para pessoas de gênero dissidente e sobre gênero se materializam em diferentes regimes enunciativos, e que os dispositivos de controle e de disciplinamento são visíveis no discurso legislativo, o corpus foi composto por cinco objetos de análise, quais sejam: pelas Diretrizes Sobre Proteção Internacional N. 01 (2002) e N. 09 (2012), do ACNUR; pela Resolução 17/19, da ONU, de 2011; e pelas falas coletadas de duas lives promovidas pela ONU, a saber: ONU ? orgulho sem fronteiras, ocorrida em 17 de maio de 2021; e Empregabilidade LGBTQIAP+, ocorrida em 28 de janeiro de 2021. A análise do corpus permitiu afirmar que o corpo dos sujeitos dissidentes refugiados está numa zona cinzenta, em que se torna campo de batalha biopolítica de controle entre as razões humanitárias e o Estado, esse revestido pela lógica neoliberal mercadológica, o que produz o efeito de que esse sujeito não merece viver. Nessa polivalência, as estratégias dos discursos que sustentam o dispositivo do gênero dissidente se mostram pluralizadas entre salvar essas pessoas da violência, por razões humanitárias, ao mesmo tempo em que, paradoxalmente, as excluem no apagamento de sua existência nos documentos, afastando-as da responsabilidade do Estado

Abstract: This work was dedicated to analyzing the biopower relationships that occur between the dissident refugee person and the State in the asylum application process, through the reference documents analysis (legal and pedagogical) which materialize the discourses about refuge for dissident gender people. To this end, taking into consideration the fact that the discourses about refuge for dissident gender people and about gender materialize in different enunciative regimes, and that the control and disciplining devices are visible in the legislative discourse, the the corpus was composed of five analysis objects, namely: by the Guidelines on International Protection N. 01 (2002) and N. 09 (2012), of UNHCR; by UN Resolution 17/19, 2011; and by the speeches collected from two Lives promoted by the UN, namely: UN ? pride without borders, held on May 17, 2021; and LGBTQIAP+ Employability, held on January 28, 2021. The analysis of the corpus allowed us to affirm that the dissident refugees body is in a gray zone, in which it becomes a biopolitical battlefield of control between humanitarian reasons and the State, the latter covered by the neoliberal market logic, which produces the effect that this subject does not deserve to live. In this polyvalence, the discourses strategies that support the device of the dissident genre appear to be pluralized between saving these people from violence, for humanitarian reasons, while paradoxically excluding them in the erasure of their existence in documents, removing them from the State?s responsibility.
