Desapropriações em obras de infraestrutura rodoviária: alternativas aos procedimentos atuais

Abstract

A temática abordada nesse trabalho refere-se aos procedimentos utilizados nas desapropriações em obras de infraestrutura rodoviária, onde se busca, por meio de uma fundamentação teórica baseada em leis e normas, associadas a uma análise dos custos totais inerentes à implantação de uma obra de infraestrutura rodoviária, analisar os fatores que levam a uma eventual supervalorização de imóveis afetados entre a data de aprovação do projeto até a fase de desapropriação em si e a forma como esta pode vir a influenciar na majoração de tais custos. Tal situação será demonstrada por meio de três estudos de caso em desapropriações parciais efetivamente realizadas em zonas rurais na Grande Florianópolis, tendo sido observados diversos equívocos técnicos nas avaliações realizadas pela empresa contratada pela Concessionária, os quais tiveram sua importância na diferença entre os valores esperados para aqueles efetivamente praticados, ainda que este não tenha sido o principal fator ? conforme será demonstrado, a alteração do zoneamento em áreas subutilizadas o é. Paralelamente, por meio de um estudo acerca dos procedimentos desapropriatórios adotados em diversos países, aliado a uma revisão sistemática que auxilie nas fundamentações necessárias, são apresentados ao final sugestões alternativas aos procedimentos atualmente utilizados no Brasil, sem a necessidade de alteração da legislação ou das normas vigentes. Pelo todo exposto, buscou-se assim deduzir que com o uso dos gastos públicos de forma técnica e consciente nas desapropriações, abre-se a possibilidade de se executar obras de infraestrutura rodoviárias de forma mais previsível em relação aos custos, bem como de uma cobrança mais coerente das tarifas de pedágio.

Abstract: The theme addressed in this work refers to the procedures used in expropriations in road infrastructure works, where it is sought, through a theoretical foundation based on laws and regulations, associated with an analysis of the total costs inherent in the implementation of a road infrastructure work, seeks to analyze the factors that lead to a possible overvaluation of the affected properties between the date of approval of the project until the expropriation phase itself and how it may influence the increase in such costs. This situation will be demonstrated through three case studies in partial expropriations effectively carried out in rural areas in Florianópolis Metropolitan Area, with several technical mistakes being observed in the evaluations made by the company hired by the Concessionaire, which had their importance in the difference between the values expected for these practiced, even though this was not the main factor - as will be presented, changing the zoning in underdeveloped lands is. At the same time, by means of a study on the expropriation procedures adopted in several countries, coupled with a systematic review that helps with the necessary substantiations, alternative suggestions to the procedures currently used in Brazil are presented at the end, without the need to change the legislation or the current rules. Thus, it sought to deduce that with the use of public spending technically and consciously way in expropriations, the possibility of carrying out road infrastructure works in a more predictable way in relation to costs opens up, as well as of a more coherent toll collection.
