Responsabilidade Objetiva do Empregador: Efetivação do Meio Ambiente do Trabalho Psicologicamente Saudável

Abstract

O trabalho tem como tema a responsabilização do empregador pelo Meio Ambiente do Trabalho psicologicamente saudável e objetiva investigar se a Responsabilidade Objetiva é a resposta para a questão dos crescentes índices de doenças mentais laborais. Observa-se uma fragilidade argumentativa do nexo causal entre o dano e o trabalho para a Responsabilidade Subjetiva, culminando assim, na vinculação arbitrária e inconsistente da posição dos magistrados. Para tanto, essa pesquisa conceitua e fortalece as bases do Meio Ambiente do Trabalho e da Responsabilidade Objetiva, que por meio da interlocução entre Psicologia Jurídica, doutrinadores especialistas e jurisprudência, verifica a adequação do assunto. O resultado encontrado foi de que apesar do cabimento e crescimento da Responsabilidade Objetiva nos Tribunais, não torna efetivo o meio ambiente laboral psicologicamente sadio. Os estudos foram organizados de forma qualitativa, pelo método indutivo, a partir da coleta de informações de fontes secundárias através de pesquisa bibliográfica.

The theme of the work is the responsibility of the employer for the psychologically healthy work environment and aims to investigate whether Objective Responsibility is the answer to the question of increasing labor rates. There is an argumentative fragility of the causal link between damage and work in Subjective Responsibility, thus culminating in the arbitrary and inconsistent connection of the position of magistrates. To this goal, this research conceptualizes and fortifies the foundations of the Environment of Labor and Objective Responsibility, which through dialogue between Legal Psychology, expert indoctrinators and jurisprudence, checks the adequacy of the subject. The main result is that despite the appropriateness and growth of the Objective Responsibility in Courts, it does not make the work environment effective psychologically healthy. The studies were organized in a qualitative way, by the inductive method, from the collection of information from secondary sources through bibliographic research.
