Experiências de trabalhadores rurais na Justiça do Trabalho: Lages-SC, 1970-1980

Abstract

A pesquisa investiga as relações de trabalho rural na região do planalto serrano catarinense, as experiências dos trabalhadores e as disputas ocorridas na Justiça do Trabalho. As principais fontes que a compõe são as ações trabalhistas ajuizadas na Junta de Conciliação e Julgamento de Lages. O acervo está salvaguardado pelo Setor de Memória Institucional do TRT-12. Aborda-se o processo de construção de uma legislação trabalhista rural, bem como as disposições do Estatuto do Trabalhador Rural (1963) e da Lei 5.889, de 1973. A pesquisa constata que os trabalhadores rurais atuavam em diversas atividades econômicas, como agricultura, pecuária de corte e leiteira, e cultivo florestal. Aponta as particularidades das experiências dos trabalhadores em cada uma delas, já que havia diferentes relações de trabalho, moradia e uso da terra. Relaciona tais experiências à formação histórica da economia do planalto, às transformações acarretadas pela indústria madeireira e ao projeto da ditadura para o campo brasileiro. Procura compreender diferentes disputas trabalhistas, a fim de apontar os principais pontos de discordância, os argumentos esgrimidos pelas partes e os elementos levados em conta pelos julgadores ao proferirem as sentenças. Leva em conta, ainda, a parte da disputa que ocorria fora da arena judicial. Argumenta que as disputas trabalhistas podem ser entendidas como parte da luta de classes. Isto porque a Justiça do Trabalho entendia as partes da disputa não como indivíduos, mas como integrantes cada qual de sua classe. Há indícios de organização e solidariedade entre trabalhadores a fim de ajuizar reclamatórias e aumentar as chances de vencê-las. Muitas das reclamatórias eram coletivas, e seus resultados não se restringiam aos reclamantes, surtindo efeitos mais gerais. A Justiça do Trabalho constituía, na região do planalto catarinense, uma via importante de luta, dado o estado de organização dos trabalhadores e as restrições políticas do período ditatorial.

Abstract: The aim of this research is to investigate the rural labor relations in the Santa Catarina highlands region, the workers' experiences and the disputes that occurred in the Labor Court. The main sources that compose it are the labor lawsuits filed at the Board of Conciliation and Judgment of Lages. This collection is safeguarded by the Institutional Memory Sector of TRT-12. The process by which the rural labor legislation was created is addressed, as well as the provisions of the Rural Worker Statute (1963) and Lei 5889/1973. The research verifies that rural workers were active in several economic activities, such as agriculture, cattle raising, dairy farm and forestry. It points out the particularities of the workers' experiences in each of them, since there were different labor relations, housing and land use. It relates these experiences to the historical formation of the region?s economy, to the transformations caused by the timber industry and to the dictatorship project for the Brazilian countryside. It tries to understand different labor disputes, in order to make explicit the main points of disagreement, the arguments wielded by the contenders and the elements taken into account by the judges when delivering the sentences. It also takes into account the part of the dispute that occurred outside the judicial arena. It argues that labor disputes can be understood as part of the class struggle. This is because the Labor Court understood the parties to the dispute not as individuals, but as members of each class. There are signs of organization and solidarity among workers in order to file petitions and increase the chances of winning them. Many of the lawsuits were collective, and their results were not restricted to petitioners, with more general effects. The Labor Court was, in the region of the Santa Catarina highlands, an important vehicle of struggle, given the state of organization of workers and the political restrictions of the dictatorial period.
