As prerrogativas políticas da plebe na antiga Roma republicana.

Abstract

O controle e equilíbrio entre as diferentes funções e poderes na república romana antiga são construídos com base em magistraturas, no exercício do direito de veto, a necessidade de quorum nas assembleias populares tendo em conta os limites de tempo de cada função e do direito a eleições. Portanto, muitos conceitos constitucionais modernos parecem derivados de algumas instituições romanas e entre os instrumentos de poder está o protagonismo político da plebe. Quanto à concentração dos poderes na mão dos patrícios determinaria o forte atrito entre as duas ordens nos dois primeiros séculos da república, onde nasce o desejo da população em alcançar cargos mais elevados, do mesmo modo que a participação, liberdade e igualdade política são construídas em correspondência a todos os bens, direito e interesses romanos. Assim, buscou-se neste trabalho o encontro da legitimação fundada pelo consentimento do povo, qual deve se dar como um fator decisivo e complementar as instituições políticas quando justifica a permanência na história da antiguidade até as vias que ligam o pensamento político da linguagem da res publica e da res populi.

The control and balance among the different functions and powers in the ancient Roman Republic are built based on magistrates, exerting the power of veto, the need of quorum at the popular assemblies taking in consideration the time limit of each function and the right of elections. Thus, many of the modern constitutional concepts seem derivative of some of the Roman institutions that carried the political participation of the plebeian within the instruments of the political power. As for the concentration of powers among the Patricians, it would determine the intense conflict between the two orders during the two first centuries of the republic, when there was a desire of the population for higher positions, the same way that participation, freedom and political equality are built in correlation with wealth, right, and roman interests. Therefore, this work intends to find the probation generated by people's consent, which must be a decisive factor and complement the political institutions when it justifies the abiding of ancient history in the paths that link the political thinking of the language in the res-publica and res-populi.
