A repercussão do novo código de processo civil no direito marítimo: limites da eficácia da decisão do tribunal marítimo

Abstract

The objective of this work is to study the aspects of the New Code of Civil Procedure in Maritime Law and especially in the Maritime Court, going through the history, aspects, process and procedures of this Court of the Sea. Following, importance is given to the new and old institutes of the New Codex of Civil Procedure bringing procedures that are closely related to the Maritime Law and its historical evolution within the Maritime Process. Finally, the most difficult problem of the present work is raised, namely, the legal analysis and effectiveness of the decisions of the Maritime Court before the Judiciary, addressing first the legal nature of the decisions following with the doctrinal agreement on the matter, and concluding with brief jurisprudential analysis.

O objetivo deste trabalho é estudar os aspectos do Novo Código de Processo Civil no Direito Marítimo e principalmente no Tribunal Marítimo, passando-se pelo histórico, aspectos, processo e procedimentos desta Corte do Mar. Em sequência, dá-se importância a novos e velhos institutos do Novo Códex de Processo Civil trazendo procedimentos que se relacionem intimamente com o Direito Marítimo e sua evolução histórica dentro do Processo Marítimo. Por fim, levanta-se a problemática mais espinhosa do presente trabalho, qual seja, a análise jurídica e eficácia das decisões do Tribunal Marítimo perante o Poder Judiciário, abordando-se primeiramente a natureza jurídica das decisões e em sequência o dissídio doutrinário acerca da matéria, e concluindo com análise jurisprudencial
