Sistema Penal e Regulação: fundamentos para uma análise da Economia Política da Pena

Abstract

O presente trabalho pretende realizar uma análise histórica do Direito Penal e dos Sistemas Penais a partir de sua relação com a estrutura social, buscando compreendê-los como elementos constituintes dos modos de regulação. Trata-se de monografia que se insere teoricamente no campo da Criminologia Crítica ou Radical e fundamenta-se no marxismo. A investigação passa, inicialmente, por um nível abstrato de análise do Direito Penal e da forma da pena no capitalismo, utilizando-se, para tanto, da teoria formulada por Pachukanis a respeito da forma jurídica, do contrato e do sujeito de direito, bem como das categorias marxianas da mercadoria, do valor e do trabalho abstrato. Em seguida, cumpre-se a tarefa de verificar a forma política do Estado capitalista e de como se conforma, em seu interior, a dominação de classe. Parte-se, então, para o exame da Teoria da Regulação e de suas formulações sobre como ocorre a manutenção da estabilidade e da coesão sociais no capitalismo. Utiliza-se, para tanto, dos conceitos de Regime de Acumulação e Modo de Regulação e de suas expressões específicas no fordismo e no pós-fordismo. São verificadas, então, as linhas gerais da Economia Política da Pena e, em seguida, as especificidades dos sistemas penais nos contextos do fordismo e do pós-fordismo. Observa-se a passagem de um sistema penal voltado à disciplina do trabalho para um sistema penal que se pauta pelo controle do risco, a partir da lógica atuarial. Entende-se que os sistemas penais historicamente determinados são parte essencial dos modos de regulação e cumprem função indispensável para a produção e reprodução da sociedade.

The current study intends to realize a historical analysis of Criminal Law and Criminal Systems based on their relation to the social structure, seeking to understand them as constituent elements of modes of regulation. This is an undergraduate thesis that is theoretically inserted in the Radical or Critical Criminology field of study and it has its theoretical foundations on Marxism. The research work was developed as follows: Initially, it presents an abstract level of analysis of criminal law and the form of punishment in capitalism, using Pashukanis's theory of legal form as well as the Marxian categories of the commodity, value and abstract work. Secondly, it verifies the political form of the capitalist state and of how within itself the class domination is accomplished. Then, it begins to examine the Regulation Theory and its formulations on how to maintain social stability and cohesion in capitalism. For this purpose, the concepts of Accumulation Regime and Mode of Regulation and their specific expressions in Fordism and post-Fordism are used. Thereafter, the general lines of the Political Economy of Punishment are verified, and subsequently the specifics of the criminal systems in the contexts of Fordism and post-Fordism. The study observed the passage from a penal system directed to the labor discipline to a penal system that is guided by the control of risk, from the actuarial logic. It considered that historically determined criminal systems are an essential part of the modes of regulation and play an indispensable role in the production and reproduction of society.
