Aggravated Damages, Punitive Damages e a função punitiva no Direito Civil brasileiro

Abstract

Dentro do importante debate sobre a aplicabilidade da função punitiva na responsabilidade civil, em particular, na indenização por danos extrapatrinomiais, essa pesquisa buscou compreender as características, funções e distinções entre os punitive damages, dos quais muito se fala na jurisprudência, a fim de fundamentar a função punitiva no arbitramento do quantum indenizatório; os aggravated damages, instituto próximo, de função compensatória que exprime reprovação de conduta, característico do Direito Inglês, também pertencente à família do Common Law; e da indenização de caráter punitivo que de fato é concedida no Brasil.

Within the relevant debate whether the punitive role in civil liability applies, in particular, in damages regarding non-pecuniary loss, this research sought to understand the qualities, purposes and differences amongst the punitive damages, which are most mentioned in case-law, intending to underlie the punitive role in awarding damages; the aggravated damages, a close institute, of compensatory role that states the disapproval of a conduct, typical of English Law, also belonging in the Common Law; and the damages with the punitive element that is, in fact, awarded in Brazilian Law.
