Estado Laico e Religião: um relacionamento saudável.

Abstract

Trata-se de trabalho acadêmico com o objetivo de estudar a relação entre Estado Laico e Religião, partindo da demonstração através de exemplos retirados da história ocidental e do Brasil de como a Religião influencia os indivíduos, e a partir destes, a sociedade e o Estado, ainda que Laico, demonstrar através da história do Estado Laico a influência e interesse da Religião na laicidade estatal, trazer diferentes modelos de como diferentes sociedades podem sustentar um Estado Laico, em relação ao relacionamento com a Religião, especificamente analisando os modelos de separação, igualdade e aproximação trazidos por Winfried Brugger, elencando vantagens e desvantagens de cada um sendo, e analisar a proteção que o Estado Laico, de fato, pode oferecer à Religião em um Estado Constitucional, diferenciando Estado Laico, onde o Estado deve proteger a Religião, de Estado Ateu, bem como diferenciando a proteção à Religião no Estado Laico da proteção à Religião no Estado Confessional, e, por fim, analisando especificamente a proteção à Religião propriamente dita, como Direito Fundamental de primeira geração e a proteção a Religião como cultura, Direito Fundamental de terceira geração.

It is academic work with the objective of studying the relationship between Secular State and Religion, based on the demonstration through examples from Western and Brazil's history of how Religion influences individuals, and through these, the society and the state, although secular; demonstrate through the history of Secular State the influence and interest of Religion in state secularism; bring different models of how different societies can sustain a Secular State, in relation to the relationship with Religion, specifically analyzing the models of separation, equality and approach brought by Winfried Brugger, listing advantages and disadvantages of each one, and; analyze the protection that the Secular State, in fact, can offer to Religion in a Constitutional State, differentiating Secular State, where the state must protect Religion, from Atheist State, and differentiating the protection of Religion in Secular State and the protection of Religion in the Confessional State, and, finally, specifically analyzing the protection of Religion itself, as Fundamental Right of first generation and the protection of Religion as culture, Fundamental Right of third generation.
