Análise do caso do Turismo de Observação de Baleias Embarcado na zona de amortecimento da APA da Baleia Franca, à luz dos princípios da Precaução e da Prevenção.

Abstract

A presente monografia tem por objetivo analisar o histórico da proteção ambiental, bem como o momento chave que ocasionou a conscientização mundial de sua necessidade – a crise ambiental; verificando que o Direito Ambiental e seus princípios, bem como a nova área do Direito Animal, são significantemente primordiais para que essa proteção seja cada vez mais efetivada. Utilizando o método dedutivo, serão analisadas ainda, as correntes da ética ambiental, que dão fundamento ao Direito Animal; a evolução legislativa do direito ambiental, focando nas normas que dizem respeito à fauna; a tutela constitucional do tema, bem como decisões relacionadas ao tema, chegando ao ponto central do trabalho, que é o enfoque na proteção da baleia-franca e o julgado que suspendeu o Turismo de Observação de Baleias Embarcado na Área de Proteção Ambiental da Baleia Franca. Sobre esse tema especificamente, foram examinados aspectos históricos quanto a essa espécie de cetáceo, bem como a criação da Área de Preservação Ambiental da Baleia Franca e a necessidade de aplicação dos princípios da Precaução e da Prevenção no julgado escolhido, destacando-se as peculiaridades dos referidos princípios.

This thesis aims to analyze the history of environmental protection as well as the key moment that led to the global awareness of their need - the environmental crisis; verifying that the Environmental Law and its principles, as well as the new area of the Animal Law, are significantly paramount to maintain this protection is increasingly effective. Using the deductive method, will still be analyzed, current environmental ethics, which give grounds to the Animal Law; the legislative evolution of environmental law, focusing on the rules concerning the fauna; the constitutional protection theme, as well as decisions related to the subject, reaching the midpoint of the work, which is the focus on protecting the right whale and the case that suspended the Onboard Whale Watching Tourism in Environmental Protection Area of the Right Whale. For this, historical aspects will be studied as this cetacean species as well as the creation of the Environmental Protection Area of the Right Whale. Coming to an end, to examine the principles of precaution and prevention, highlighting its peculiarities and dimensions in order to demonstrate the reason they are the basis of the judgment in question.
