Desconstruindo o Direito: elementos para uma práxis jurídica emancipatória

Abstract

Busco com esta pesquisa investigar a possibilidade de desenvolvimento de uma práxis jurídica emancipatória a partir do desconstrutivismo derridiano. Para tanto, delineio no capítulo inaugural a faceta discursiva e sociocultural do Direito, ressaltando o paradigma racionalista que o caracteriza na atualidade através de uma breve retomada da Teoria Pura do Direito de Hans Kelsen, e apontando para algumas das características que permitem uma abordagem desconstrutivista desse Direito. No segundo capítulo, exponho os fundamentos da teoria e do método desconstrutivista e com eles abordo o paradigma racionalista do Direito. Ao final dessa parte, exponho acerca da importância e da premência de se instrumentalizar o Direito para propósitos emancipatórios, tema que se aprofunda no capítulo final.

With this research I investigate the possibility of developing a deconstructive approach to Law that may render it instrumental to a politically emancipatory legal praxis. In order to do that, in the first chapter of this work I delineate the discursive and sociocultural aspect of Law, highlighting its grounds on the scientific paradigm by briefly examining Hans Kelsen’s Pure Theory of Law and then pointing towards the main aspects that allow such deconstructive approach of Law. In the second chapter, I revisit the core fundamentals of the deconstructive theory and method and through them I approach the scientific paradigm of the legal studies and practice. In conclusion to that chapter, I develop on the importance and urgency of approaches to Law that enable politically emancipatory readings and practices of the discipline, a theme which is further developed in the closing chapter.
