Em Busca da Verdade Real: entre queijos e vermes

Abstract

Por meio da análise do Manual dos Inquisidores, da leitura do julgamento do moleiro Menocchio e do exame de legislação pertinente a monografia objetiva estudar o mito da “Busca da Verdade Real”, no processo penal, via atualização da lógica inquisitorial. Assim, dentro da perspectiva inquisitorial apresentada na obra de Nicolau Eymerich (Manual dos Inquisidores) e do relato detalhado do julgamento de Domenico Scandella (Menocchio) pela Inquisição na obra de Carlo Ginzburg, objetiva-se analisar a atuação do juiz no curso da instrução probatória do processo penal brasileiro à luz dos ditames do sistema acusatório, a fim de averiguar a eventual compatibilidade entre este e a outorga de poderes instrutórios ao juiz. Inicialmente, analisa-se quais os limites da jurisdição do inquisidor, bem como as formas de interrogatório inquisitorial apresentada na obra de Eymerich. A seguir, passa-se a leitura do caso de Menocchio, buscando-se comparar os modelos de sistemas processuais com o modelo inquisitorial existente no julgamento do moleiro. Por fim, verifica-se os limites da atuação instrutória do juiz criminal no processo penal brasileiro após a adoção do sistema acusatório pela Constituição Federal de 1988, traçando breves considerações sobre as formas de produção da verdade no processo penal à luz da teoria dos Jogos.

Through the analysis of the Manual of Inquisitors, reading the Menocchio the miller’s judgment and examining relevant legislation, this monograph aims to study the myth of "Pursuit of Real Truth" in criminal proceedings, through the update of the inquisitorial logic. Thus, within the inquisitorial perspective presented in Nicolau Eymerich opus (the referred Manual of Inquisitors) and the detailed account of the trial of Domenico Scandella (Menocchio) by the Inquisition in the work of Carlo Ginzburg, the objective herein is to analyze the role of the judge in the evolutionary course of evidential statement in Brazilian criminal justice in light of the precepts of the adversarial system in order to ascertain the possible compatibility between this and granting investigating powers to the judge. Initially, the focus is on what would be the limits of the Inquisitor's jurisdiction, as well as the forms of inquisitorial interrogation presented in Eymerich's work. Next, the reading of Menocchio's case while seeking to compare the procedural systems' models with the inquisitorial model found on the miller's judgment. Lastly, one verifies the limits of the criminal judge's investigating powers in criminal proceedings in light of Game Theory.
