A diluição do potencial político da participação social: o caso do Conselho Municipal de Educação de Florianópolis

Abstract

O presente trabalho se situa entre os estudos que buscam compreender o avanço das novas instituições participativas que surgem no Brasil após a Constituição de 1988. Os exemplos mais citados dessas instituições são o Orçamento Participativo e os Conselhos Gestores de Políticas Públicas, sendo selecionado o segundo exemplo para análise neste trabalho. O foco da pesquisa foi apontar mudanças produzidas no desenho institucional do Conselho Municipal de Educação de Florianópolis (CME) a partir da aprovação da Lei n. 10.773/2021 e seus efeitos sobre a participação social nas decisões do órgão. Os dados utilizados foram as leis municipais que envolvem a organização administrativa do CME e demais documentos legais, como o Regimento Interno. Após a seleção desses documentos, foi realizada uma análise documental que comparou os textos das leis relacionadas ao CME, apontando as regras presentes antes e depois da aprovação da Lei n. 10.773/2021. O resultado das análises aponta que a reorganização da estrutura institucional, após a aprovação da lei, carrega elementos muito danosos para o potencial da participação social nas decisões do conselho, além de sujeitar a aprovação de suas decisões ao poder executivo municipal.

This work is among the studies that seek to understand the advance of the new participatory institutions that appear in Brazil after the 1988 Constitution. The most cited examples of these institutions are the Participatory Budget (OP) and the Management Councils of Public Policies (CGPP), the second example was selected for analysis in this work. The focus of this research is to point out the changes produced in the institutional design of the Municipal Council of Education of Florianópolis (CME) from the approval of the Law n. 10.773/2021, and its effects on the social participation in the council's decisions. The data used were the municipal laws that are related to the administrative organization of the CME and other legal documents, such as the Internal Regulations. After the selection of these documents, a documental analysis was made in order to compare the texts of the laws related to the CME, pointing out the rules presented before and after the approval of the Law n. 10,773/2021. The results of the analyzes indicate that the reorganization of the institutional structure, after the approval of the law, carries elements that are very harmful to the potential of social participation in the decisions of the council, in addition to submit the aproval of its decisions to the municipal executive power.
