Abstract: This research investigates the role of communication as a constitutive and strategic element in the legal proceedings brought by the Quilombola communities of Alcântara (Maranhão, Brazil) against the Brazilian State before the Inter-American System of Human Rights. This historical conflict originated from the territorial expropriations driven by the establishment of the Alcântara Launch Center (CLA) back in the 1980s. The objective of this study is to analyze the complex narrative dispute present in the trial hearings and across all documentation generated by the legal representations of the involved parties, as well as by the Inter-American Commission on Human Rights (IACHR) and the Inter-American Court of Human Rights (IACourtHR) throughout the entire litigation. Rejecting fragmented temporal scopes, this research analyzes the entirety of the case's documentary corpus to understand the dialectical movement of the arguments. Methodologically, we adopt a multi-methodological approach. We employ Grounded Theory (GT) to examine the transcripts of the public hearings and identify the communication categories emerging from the parties' orality. In a second analytical stage, we draw upon Critical Discourse Analysis (CDA), based on Norman Fairclough's framework, to investigate the materiality of legal discourse within the case files. The results demonstrate that the litigation goes beyond a land dispute, revealing itself as an arena where communication is used as a praxis of rehumanization and the constitution of new political subjects against the violence and dehumanization of colonial foundations operated by the State and the media. The analysis evidences that the Brazilian State sustained a deliberate project of silencing, defined as a policy of acomunicação (non-communication), while institutional and mainstream journalism proved to have epistemic irrelevance throughout the dispute. We conclude that the Inter-American System of Human Rights acted as a fundamental stage of visibility in which the Quilombola communities of Alcântara managed to break the non-communication imposed by the State, obtaining the recognition of the damages inflicted upon their collective life project. Consequently, the Inter-American Court utilized its own ruling and press releases as legitimate instruments of memory and historical reparation. |
