A presente pesquisa investiga o habeas corpus enquanto instrumento jurídico utilizado por
pessoas escravizadas, libertas ou livres racializadas, que estiveram sob a ameaça da
(re)escravização ou já ilegalmente escravizadas nas últimas duas décadas da escravidão. O
trabalho, situado no campo da história social do direito, procurou investigar os fundamentos, a
prática e os resultados da utilização desse recurso não apenas como meio de buscar a liberdade
física e de locomoção, mas como alternativa para obter ou manter o reconhecimento do estatuto
jurídico de livre ou liberto, e junto com ele a cidadania, em um contexto de precariedade
estrutural da liberdade. Primeiro, examinou-se a legislação oitocentista, bem como livros e
periódicos jurídicos coevos, que tentaram construir doutrinas e consolidar a jurisprudência
acerca do emprego do habeas corpus no Brasil. Em seguida, buscou-se analisar, em processos
de habeas corpus tramitados entre 1871 e 1888, as diferentes situações de “constrangimento
ilegal” situadas no limiar entre escravidão e liberdade, os variados argumentos e estratégias
adotados pelos curadores nas petições, bem como as respostas dadas pelo Judiciário a essas
iniciativas de emprego do instituto. Para isso, foram utilizados tanto os habeas corpus
impetrados no Supremo Tribunal de Justiça, que se encontram atualmente no Arquivo Nacional,
quanto aqueles publicados nas revistas jurídicas “O Direito” e “Gazeta Jurídica”. |

This research investigates habeas corpus as a legal instrument used by enslaved, freed, or free
racialized people who were under the threat of (re)enslavement or were already illegally
enslaved, in the last two decades of slavery. The study, situated in the field of the social history
of law, aimed to investigate the foundations, practice, and results of using this remedy not only
as a means to seek personal liberty and freedom of movement, but as an alternative to obtain or
maintain the recognition of the legal status of free or freed, and along with it, citizenship, in a
context of structural precariousness of freedom. First, the nineteenth-century legislation was
examined, as well as coeval legal books and periodicals, which attempted to build doctrines and
consolidate jurisprudence regarding the use of habeas corpus in Brazil. Subsequently, the study
sought to analyse, in habeas corpus proceedings adjudicated between 1871 and 1888, the
different situations of “illegal constraint” situated on the threshold between slavery and
freedom, the various arguments and strategies adopted by curators in the petitions, as well as
the responses given by the Judiciary to these initiatives employing the legal instrument. To this
end, both the habeas corpus petitions filed with the Supreme Court of Justice, which are
currently located in the National Archive, and those published in the law journals O Direito and
Gazeta Jurídica were utilized. |
