No ano de 1947 a Organização das Nações Unidas (ONU)
aprovou o plano de partição da região da Palestina, após meio século de conflitos
na região. A aprovação da ONU resultou no deslocamento de milícias armadas
compostas por imigrantes judeus na região para as fronteiras delimitadas no
plano. Em 14 de outubro de 1948, líderes dos assentamentos judeus na Palestina
declaram a existência do Estado de Israel. Os países árabes (Jordânia, Egito,
Líbano, Síria e Iraque) imediatamente iniciam uma ofensiva militar contra Israel,
mas restaram derrotados. Após, várias outras guerras aconteceram, em especial
a Guerra dos Seis Dias, em junho de 1967, quando Israel amplia
significativamente suas fronteiras no Oriente Médio, através de uma ação militar
sem precedentes na história. Entretanto, é apenas na década de 90 que ocorrem
os primeiros passos significantes no processo de paz na região, através dos
acordos de Oslo em 1993 e de Washington em 1995 (também conhecido como
Oslo II). Através desses acordos as regiões da Faixa de Gaza e Margem
Ocidental passariam gradativamente ao controle de um Conselho Palestino, a ser
eleito em alguns meses. As eleições aconteceram em 1996, contudo, revoltas
civis e desavenças internas demonstraram que a Autoridade Palestina recém
eleita não contava com o apoio majoritário da população. Atualmente, apenas a
Faixa de Gaza se encontra sob o governo da Autoridade Palestina, a Margem
Ocidental permanece sob domínio israelense. A formação do Estado de Israel,
apesar de seu reconhecimento expresso por vários países e seu ingresso como
país membro da ONU em 49, deixa dúvidas quanto a sua legitimidade frente aos
princípios da Carta da ONU. As resoluções da ONU - que sobrevieram aos
eventos que resultaram na ocupação israelense - são também discutíveis sob о
ponto de vista da legitimidade da ONU em deliberar sobre assuntos relacionados
e sob o ponto de vista de afronta direta aos seus princípios. A ocupação de
territórios pela via armada é condenada no artigo 1º. da Carta da ONU, contudo,
foi o método utilizado por Israel em 1948, 1967 e 1978, nas respectivas guerras
de conquista. O atual estágio do processo de paz é preocupante, desde setembro
de 2000 um intenso movimento de revolta civil se iniciou nos territórios ocupados.
Uma solução para o conflito parece impossível, porém, é viável a adoção de
medidas preventivas, que possibilitariam a abertura de novas frentes de
negociações, como a criação de um Estado Palestino soberano na Faixa de Gaza
e na Margem Ocidental, atendendo às expectativas dos acordos de paz de 93 e
95; um controle mais efetivo, por parte da própria polícia palestina, das atividades
terroristas de grupos fundamentalistas islâmicos; e uma cooperação internacional
no sentido de promover um real e substancial desenvolvimento econômico nos
territórios ocupados. |

In the year of 1947 the United Nations Organization (UN)
approved the plan of partition of the region of Palestine, after half century of
conflicts in the region. The approval of the UN resulted in the shift of composite
armed military services for Jewish immigrants in the region for the borders
delimited in the plan. In 14 of October of 1948, leaders of the Jewish nestings in
Palestine declared the existence of the State of Israel. The Arab countries (Jordan,
Egypt, Lebanon, Syrian and Iraq) immediately initiated an offensive military action
against Israel, but they were defeated. After, several other wars had happened, in
special the War of the Six Days, in June of 1967, when Israel extended
significantly its borders in the Middle East, through a military action without
precedents in history. However, it is only in the decade of 90 that the first
significant pacings in the process of peace in the region occured, through the
agreements of Oslo in 1993 and Washington in 1995 (also known as Oslo II).
Through these agreements the regions of the Gaza Strip and West Bank would
pass gradual to the control of a Palestinian Advice, to be elected within some
months. The elections had happened in 1996, however, civil revolts and internal
disagreements had demonstrated that just elect the Palestine Authority did not
count on the majority bracket of the population. Currently, only the Gaza Strip is
under the government of the Palestine Authority, as the West Bank remains under
Israeli domain. The formation of the State of Israel, although its express
recognition for some countries and its ingression as country member of the UN in
49, leaves doubts how much its legitimacy front to the principles of the UN
Charter. The UN resolutions that came out to the events that had resulted in the
Israeli occupation, are also arguable under the point of view of the legitimacy of
the UN in deliberating on related subjects and under the point of view of it
confronts direct to its principles. The occupation of territories for armed path is
condemned in the article first of the UN Charter, however, it was the method used
for Israel in 1948, 1967 and 1978, in the respective wars of conquest. The current
period of the peace process is preoccupying. Since September of 2000 an intense
movement of civil revolt had initiated in the occupied territories. A solution for the
conflict seems impossible, however, is viable the adoption of writs of prevention,
that would make possible the aperture of new fronts of negotiations, as the
creation of a sovereign Palestinian State in the Gaza Strip and West Bank, taking
care of to the expectations of the peace accords of 93 and 95; one has controlled
effective more, on the part of the proper Palestinian policy, the terrorist activities of
international cooperation in the direction to Islamic fundamentalist groups; and an
promote a real and substantial economic development in the occupied territories. |
