dc.description.abstract O presente estudo examina a validade dos contratos que não observam o princípio da função social. Analisa a função social como uma norma aberta que confere ao juiz a discricionariedade na aplicação do princípio, adequando-o aos valores de determinada época. Para que esteja presente a função social, entretanto, é necessário que o contrato atenda ao bem comum e, simultaneamente, à justiça contratual. Desse modo, vislumbra-se que a lesão, assim como o abuso de direito e a onerosidade excessiva, são modalidades de descumprimento da função social. E sendo assim, são reservadas certas sanções a estes fatos socialmente indesejados. Ressaltando-se que no ajuste entre os princípios liberais e sociais da teoria contratual, o legislador dá preferência à manutenção do contrato, com a condição de que seja revisto o pactuado. A ofensa à função social pode ser alegada por terceiros lesados, pelo Ministério Público, no papel de defensor dos interesses sociais, e pela parte prejudicada. Tem, ainda, o juiz, assim que toma conhecimento, o dever de analisar de oficio o malferimento ao bem comum. pt_BR
dc.description.abstract The present study examines the validity of the contracts which don't observe the principle of the social function. It analyses the social function as an open rule that gives the judge the liberty of choice in the application of the principle, making it adequate to the values of a certain time. The social function only exists, however, if the contract attends the common wealth and, at the same time, the contractual justice. In this way, it can be seen that the hurt, as well as the law abuse and the expensiveness in excess, are types of not accomplishing the social function. It's important to mention that in the adjustment of the liberal and social principles of the contractual theory, the law maker gives preference to maintain the contract, with the condition that what has been contracted is reviewed. The offense to the social function can be mentioned by a third hurt part, by the Public Defender, who is defending the social interests, and by the part which has been prejudiced. The judge, since he knows about it, has still the duty to analyze ex officio the hurt of the common wealth. pt_BR
