Vividos, personagens e atos da medida de segurança em Santa Catarina

Abstract

Através da implantação de leis voltadas à atenção psicossocial, o Brasil vive uma crescente discussão sobre a complexidade e envolvimento das políticas públicas nacionais no que diz respeito à participação das políticas de saúde mental e à atenção psicossocial e suas convergências com o sistema judiciário. A descrição sobre as formas de atuação e de participação dos atores das políticas públicas na indicação e aplicação de medidas de segurança podem demonstrar a condução das diretrizes da política voltada ao louco infrator . Meu objetivo, neste estudo, foi compreender a indicação e a aplicação da medida de segurança ao louco infrator em Santa Catarina. Para este fim, a metodologia utilizada seguiu os pressupostos fenomenológicos apontados por Husserl, em especial sobre o posicionamento do pesquisador, traduzido como atitude frente ao fenômeno a ser investigado, e também considerou as contribuições de Alfred Schutz para a fenomenologia. Foram realizadas entrevistas e levantamento documental. O campo definido para a pesquisa foi a Comarca da Grande Florianópolis, que abriga as sedes das Secretarias de Estado de Justiça e Cidadania, de Saúde e Assistência Social, Trabalho e Habitação, a fim de facilitar meu trânsito pelos órgãos institucionais na busca de dados e documentos. Também compreende o único HCTP do estado, no qual seus profissionais técnicos são participantes ativos no expediente de avaliação e aplicação da medida de segurança no estado de Santa Catarina. Foram convidados a participar da entrevista para a pesquisa dois técnicos da área administrativa do HCTP e os dois médicos peritos responsáveis pelos laudos de insanidade mental e cessação de periculosidade. As leituras das informações transcritas das entrevistas abertas e do levantamento documental foram realizadas com base na perspectiva hermenêutica, segundo os pressupostos de Paul Ricoeur. A pesquisa possibilitou reconhecer os aspectos gerais que permeiam a medida de segurança em Santa Catarina, resultando no retrato de três grandes temáticas para discussão e diálogo com a literatura, a saber: políticas públicas, procedimentos para avaliação e aplicação da medida de segurança e, por fim, atuação técnica profissional. Ao final, pude descortinar o fluxo da avaliação e aplicação da medida de segurança, além da caracterização dos atores envolvidos nesse processo. Também me ficou demarcada a interação dos campos de conhecimento envolvidos com o sistema de justiça, revelado como coordenador dos processos em Santa Catarina. Discuti também a característica marcante de manifestações pontuais e unilateralmente planejadas neste campo, o que torna ausentes e fragilizadas as discussões sobre a condição do louco infrator em Santa Catarina, sejam elas no âmbito do controle social na implantação de políticas públicas, sejam nas relações intersetoriais para propostas de atenção a esta parcela de sujeitos, centralizando no HCTP qualquer ação relacionada com este público. Ademais, refleti sobre a ausência de integração e de investimentos técnicos e financeiros em ações de fortalecimento de rede de atenção psicossocial e seus reflexos na ausência de iniciativas de parte do Estado que acompanhem as propostas atualmente preconizadas em atos oficiais em atenção ao louco infrator .

Abstract : Through the implementation of laws aiming psychosocial care, Brazil is experiencing a growing discussion about the complexity and involvement of national public policies regarding the participation of mental health policies and psychosocial care and its convergence with the judicial system. The description about the ways in which public policy professionals act and participate in the indication and application of the security measure can demonstrate the conduct of the "mad" offender policy guidelines. The objective of this study was to understand the indication and application of the security measure to the "mad offender in the state of Santa Catarina, meaning a measure of restriction imposed by the State to mentally ill offenders who are considered not being able to be held accountable for their actions. To this end, the methodology used followed the phenomenological assumptions pointed out by Husserl in particular about the position of the researcher, translated as attitude towards the phenomenon to be investigated, and also considered the contributions of Alfred Schutz to phenomenology. Interviews and documentary surveys were carried out. The defined field for research was the Florianópolis city county, which includes its smaller cities surrounding, and houses the offices of the Santa Catarina State Department of Justice and Citizenship, the State Department of Health, the State Department of Welfare and the State Department of Work and Housing, chosen in order to facilitate the access of the researcher to data and institutional documents. It also houses the only custody hospital for psychiatric treatment in the state of Santa Catarina and where its professionals are active participants in the evaluation and application of the security measure. Two technicians from the administrative area and two medical experts of the custody hospital, these last ones responsible for the reports of mental insanity and termination of dangerousness of the offenders, were invited to participate in the interview for the research. The readings of the information transcribed from the open interviews and the documentary survey were carried out based on the hermeneutic perspective, according to Paul Ricoeur's assumptions. The research made possible the recognition of the general aspects that permeate the security measure in Santa Catarina, resulting in the portrayal of three major themes for discussion and dialogue with the literature, namely: public policies, procedures for evaluation and application of the security measure, and professional technical performance. At the end, the flow for the evaluation and application of the security measure was unveiled, besides the characterization of the professionals involved in this process. It was also defined the interaction of the fields of knowledge involved with the justice system, revealed as coordinator of the processes in Santa Catarina. It was discussed the striking feature of isolated and unilaterally planned actions in this field, which makes the discussions about the condition of the mad offender in Santa Catarina absent and fragile, whether in the scope of social control in the implementation of public policies, whether in the multiprofessional relations for proposals of attention to these subjects, centralizing in the custody hospital any action that is related to this public. In addition, there was a reflection on the lack of integration and technical and financial investments in actions to strengthen the psychosocial care network and its reflexes in the absence of initiatives at a state level that follow the current proposals advocated in official acts in the attendance of the "mad offender.
