A regularização fundiária e os seus reflexos na cidade sustentável

Abstract

A tese apresenta como objeto a análise da regularização fundiária como instrumento de concretização da cidade sustentável a partir de uma perspectiva epistemológica interdisciplinar. Justifica-se na crescente informalidade urbana, na baixa efetividade dos direitos fundamentais e na deficiência das estratégias de governança pública e de resolução de conflitos para contextos de vulnerabilidade social e ambiental. Trata-se de pesquisa qualitativa, com uso de documentação indireta, desenvolvida a partir da utilização do método indutivo. O objetivo geral da pesquisa busca avaliar as condições e possibilidades da produção do conhecimento para a implementação de estratégias de governança urbana que possibilitem o direito fundamental à cidade, destacadamente a partir da regularização fundiária sustentável no contexto da atual sociedade de risco. A abordagem da tese inicia com a caracterização geral do meio ambiente e sustentabilidade no contexto da sociedade de risco a partir de uma epistemologia interdisciplinar. Esta abordagem prossegue apresentando a relação entre aspectos fundamentais da cidade sustentável (ecológicos, econômicos, políticos, sociais e espaciais) enquanto elementos integrantes do planejamento urbano e da boa governança. Por fim, ela caracteriza o direito de propriedade e sua relação com o direito fundamental à cidade sustentável e a regularização fundiária no contexto da governança urbana a partir do Estatuto da Cidade. A tese traz como contribuição a adoção de metodologias e instrumentos de prevenção e resolução de conflitos urbanos com maior potencial para acolher conhecimentos e saberes de base cognitiva interdisciplinar como a avaliação ambiental estratégica e a realização de audiências públicas.

Abstract : The thesis presents as subject the analysis of the land regularization as a concretization instrument of the sustainable city from an interdisciplinary epistemological perspective. It is justified by the increasing urban informality, the low effectiveness of fundamental rights, and the lack of public governance and conflict resolution strategies for contexts of social and environmental vulnerability. It is a qualitative research, which uses indirect documentation and is developed from the use of the inductive method. The general aim of the research is to evaluate the conditions and possibilities of knowledge production for the implementation of urban governance strategies that make possible the city fundamental rights, especially from the sustainable land regularization in the context of the current risk society. The approach begins with the general characterization of the environment and the sustainability in the context of the risk society from an interdisciplinary epistemology. This approach evolves by presenting the relation of fundamental aspects of sustainable city (ecological, economic, political, social, and spatial aspects) as integral elements of urban planning and suitable governance. Finally, it takes into account the property right and its relationship with the sustainable city fundamental rights and land regularization in the context of urban governance based on the city statute. As the contribution, the thesis establishes the adoption of methodologies and instruments for the prevention and resolution of urban conflicts with greater potential to receive formal and informal knowledge of interdisciplinary cognitive basis such as the strategic environmental assessment and the holding of public hearings.
