Utilitarismo e direitos morais básicos

Abstract

Esta tese tem como objetivo central responder à pergunta: seria possível compatibilizar uma teoria utilitarista com a defesa consistente de um conjunto de direitos? Para responder a essa pergunta, sugiro que devemos revisitar a teoria utilitarista como um todo, ou seja, redefinir sua teoria do valor e do correto dado os problemas que encontramos nas principais teorias utilitaristas contemporâneas. Como uma concepção de direitos é um produto de uma teoria normativa utilitarista e como uma teoria normativa utilitarista é em parte dependente de uma teoria do valor, para atingir meu objetivo eu proponho o que se segue: primeiramente, oferecerei uma teoria do valor utilitarista, na qual estabelecerei aquilo que possui valor não-instrumental para nós e aquilo que possui valor instrumental para nós. Em seguida, abordo as diferentes teorias normativas utilizadas pelos utilitaristas com a finalidade de avaliar qual delas é mais plausível quando falamos de justificação de direitos. Por fim, extrairei uma concepção de "direitos morais básicos" de uma combinação entre a teoria do valor proposta e a teoria do correto proposta. Assim, espero responder à questão central deste trabalho.<br>

Abstract : This dissertation aims at answering the following question: is it possible to reconcile a utilitarian theory with a consistent defence of a set of rights? To answer this question, I will review the utilitarian theory as a whole, that is, redefine its value theory and the theory of correctness, because of the problems that we find in today's main utilitarian theories. Since a conception of rights is a product of a utilitarian normative theory and a normative utilitarian theory is a dependent part of a theory of value, for my purposes, I propose the following: First, I will offer a utilitarian theory of value. I will draw a distinction between what has no instrumental value for us and which has instrumental value only. Next, I discuss the different normative theories used by utilitarians. My purpose is to evaluate which one is more plausible when we speak about the justification of rights. Finally, I will draw a conception of "basic moral rights" from a combination of the theory of value and the theory of correctness developed in the first and second part of the work. Thus, I hope to answer the central question of this work in a positive way.
