Papéis da escravidão: a matrícula especial de escravos

Abstract

O presente trabalho versa sobre os usos que senhores fizeram da matrícula especial de escravos, instituída pela Lei 2040 de 28 de setembro de 1871. Nosso objetivo é realizar uma historicização da matrícula especial de escravos articulada à utilização desse documento para reivindicar o direito de propriedade na justiça. Para isso, buscaremos compreender quais os problemas que cercaram a matrícula, pensando o texto da lei e regulamentos em relação à prática, como autores e réus se apropriam deles para sustentar seus argumentos; em que circunstâncias a matrícula se prestou à escravidão ou à liberdade; e quais documentos deram mais força a matrícula enquanto prova de propriedade. Ações de liberdade e escravidão movidas entre os anos de 1871 e 1882, em diversas localidades do Império do Brasil, foram as principais fontes utilizadas nesta pesquisa.<br>

Abstract : This dissertation is about the uses to which you made the special registration slaves, established by Law 2.040 of September 28, 1871. Our objective is to carry out a historicization of the special matriculation of slaves articulated to the use of this document to claim the right of property in justice. For this, we will seek to understand what problems surrounded the registration, thinking the text of the law and regulations regarding the practice, as authors and defendants take ownership of them to support their arguments; circumstances in which the registration has been paid slavery or freedom; and documents which gave more power to registration as proof of ownership. Lawsuits of freedom and slavery moved between the years 1871 and 1882 in various localities of the Empire of Brazil were the main sources used in this study.
