Sob a pena do escrivão: discursos e gênero nos inquéritos policiais de crime de violência conjugal em Itajaí (1998-2010)

Abstract

O objetivo da presente pesquisa compreende a investigação e a análise dos discursos produzidos nos inquéritos policiais de crime de lesão corporal instaurados na Delegacia de Proteção às Mulheres na cidade de Itajaí, após a implantação da Lei n° 11.340 (Lei Maria da Penha), no ano de 2006. Criada por conta das pressões e lutas exercidas pelos diversos movimentos feministas e grupos de mulheres, a Lei Maria da Penha é um dos avanços sociais, juntamente com as delegacias especializadas, mais significativos no combate e enfrentamento das violências conjugais. Neste sentido, foram consultados inquéritos policiais de lesão corporal de homens contra mulheres que mantinham ou mantiveram uma relação afetiva e conjugal, instaurados na Delegacia de Proteção às Mulheres de Itajaí (DPCAMI) entre os anos de 2006 a 2010, ou seja, nos primeiros quatro anos da entrada em vigor da referida legislação. É importante destacar que, apesar da pesquisa documental abranger os anos de 2006 a 2010, faz-se necessário recuar até o ano de 1998, a fim de localizar o surgimento da DPCAMI na cidade de Itajaí e o contexto de lutas e pautas em relação às mulheres em situação de violência. Nos inquéritos policiais instaurados entre os anos de 2006 a 2010, foram selecionados 147 procedimentos, tendo como recorte a tipificação penal e a representação formal por parte das denunciantes, elemento necessário para o encaminhamento do inquérito policial ao Poder Judiciário para a fase processual. O objetivo é compreender a construção das relações assimétricas de gênero nos discursos e a constituição das percepções das violências e dos agressores por estas mulheres. Analisa-se neste estudo também, a partir dos interrogatórios dos indiciados, a masculinidade exercida por estes, percebendo como discursos que constroem e derivam práticas nas relações de gênero especialmente na esfera afetiva conjugal. Ao estabelecer estas narrativas como discursos que constroem realidades, procura-se identificar, por meio do estudo de motivos e justificativas para as violências, os significados de gênero ali engendrados, assim como as relações de poder que os produzem e que são produzidas. <br>

Abstract : The aim of this research comprises research and analysis of the statements made in police investigations of personal injury crime brought in the Protection Police Women in the city of Itajaí, after the implementation of Law 11.340 (Maria da Penha Law), in the year 2006. Built on account of the pressures and struggles carried out by various feminist movements and women's groups, the Maria da Penha Law is one of the most significant social advances for fighting and coping with domestic violence. In this regard, police investigations of injury of men against women were consulted, that maintained or kept an affective and conjugal relationship, initiated as a Police Protection Women of Itajaí between the years 2006-2010, ie in the first five years force of the law. The total surveyed, 147 procedures were selected as having cut the criminalization and formal representation on the part of the complainants, necessary element for conveying the police investigation to the judiciary to procedural stage. In these documents, first analyze the reports of the complainants in order to understand the construction of asymmetric gender relations produced by the speeches and the formation of perceptions of violence and perpetrators of these women. Analyze too, from the interrogation of the accused, the discursive construction of masculinity, perceiving them as discourses that construct and derive practices on gender relations especially in marital affective sphere. By establishing these narratives and discourses that construct realities, I try to identify through reasons and justifications for violence in the domestic sphere there engendered gender meanings as well as the power relations that produce them. Moreover, the police investigations provide objective elements of the profiles of those involved as education, age and occupation, which translate in a way, who are those guys who will go through the procedural history in the judiciary.
