A globalização, aliada ao modelo capitalista, impôs uma visão unidimensional, ao padronizar modos de vida, produtos, desejos e formas de consumo. Esse processo empobrece a diversidade cultural e ecológica, ao mesmo tempo em que reforça a dicotomia entre meio ambiente e economia. O trabalho parte dessa reflexão e do problema central da limitação do Direito Ambiental, da qual emerge o desafio de se compreender como o Direito pode atuar como instrumento de promoção da integridade ecológica, sem comprometer o desenvolvimento econômico. Sustenta-se a hipótese de que o Direito pode desempenhar um papel de compatibilização entre questões ambientais e econômicas ao incorporar a compreensão da dinâmica evolutiva da vida e dos ecossistemas. A tese se estrutura em torno de dois objetivos principais. O primeiro é a definição das Diretrizes Jurídicas de Eco-Regeneração, sistematizadas em quatro premissas: a) humanos integram um ecossistema global e suas intervenções devem ser avaliadas sob a ótica do consequencialismo ambiental; b) Direito Ecológico e teorias extrajurídicas, como Economia Ecológica e Capitalismo Regenerativo, devem orientar a análise de casos complexos; c) reconhecer o capitalismo como forma de organização da natureza, moldado por uma perspectiva ecológica e regenerativa; d) biodiversidade e regeneração são elementos essenciais à integridade ecológica e meio de subsistência e resiliência econômica. O segundo objetivo consiste na reinterpretação de dispositivos da Constituição brasileira e na aplicação das diretrizes à política agrícola, para incorporar a agricultura regenerativa como estratégia transformadora para o desenvolvimento econômico e agrícola no Brasil. Além disso, a tese explora conceitos como globalização, capitalismo, crescimento e desenvolvimento econômico, articulando-os ao pensamento complexo e à introdução de teorias extrajurídicas na interpretação do Direito, na busca pela migração da economia degenerativa para a economia regenerativa, ao repensar lucro e rentabilidade. A tese possui aderência à área de concentração Direito Internacional e Sustentabilidade do Programa de Pós-Graduação em Direito da Universidade Federal de Santa Catarina, diante da abordagem enfrentada quanto à globalização e a crise ecológica e climática contemporânea, bem como dos problemas decorrentes do sistema econômico capitalista. A pesquisa se insere na linha de pesquisa de Direito Ecológico e Direitos Humanos, ao trazer o Direito Ecológico como teoria de base e arcabouço para a construção de um método ecológico de interpretação da norma jurídica. Quanto a metodologia adota-se diferentes abordagens. O método indutivo, partindo das especificidades do sistema econômico atual para generalizar a formação de um novo paradigma. O método de hipotético-dedutivo, ao aplicar as Diretrizes Jurídicas de Eco-Regeneração para definir novas perspectivas à Política Agrícola Brasileira. E o método estruturalista, partindo-se da análise de fenômenos concretos, como problemas advindos da globalização e do sistema econômico, para formular uma teoria abstrata de bases ecológicas e regenerativas. Em síntese, o trabalho propõe que o Direito assuma papel ativo na transição para uma economia regenerativa, capaz de conciliar desenvolvimento econômico e integridade ecológica, a partir de um paradigma jurídico que valorize a biodiversidade e a regeneração como fundamentos de uma nova racionalidade econômica e social.; Abstract: Globalization, combined with the capitalist model, has imposed a one-dimensional vision by standardizing lifestyles, products, desires, and forms of consumption. This process impoverishes cultural and ecological diversity while reinforcing the persistent dichotomy between environment and economy. The work begins with this reflection and the central problem of the limitations of Environmental Law, from which emerges the challenge of understanding how Law can act as an instrument to promote ecological integrity without compromising economic development. The central hypothesis argues that Law can play a role in reconciling environmental and economic issues by incorporating an understanding of the evolutionary dynamics of life and ecosystems. The thesis is structured around two main objectives. The first is the definition of Legal Guidelines for Eco-Regeneration, systematized into four premises: a) humans are part of a global ecosystem, and their interventions must be evaluated through the lens of environmental consequentialism; b) Ecological Law and extra-legal theories such as Ecological Economics and Regenerative Capitalism should guide the analysis of complex environmental cases; c) capitalism should be recognized as a form of organization of nature, reshaped by an ecological and regenerative perspective; d) biodiversity and regeneration are essential elements of ecological integrity, as well as means of economic subsistence and resilience. The second objective consists of reinterpreting provisions of the Brazilian Constitution and applying these guidelines to agricultural policy, incorporating regenerative agriculture as a transformative strategy for economic and agricultural development in Brazil. Beyond these objectives, the thesis explores concepts such as globalization, capitalism, economic growth, and development, linking them to complex thought and the introduction of extra-legal theories into the interpretation of Law. It advocates for the transition from a degenerative economy to a regenerative one, rethinking profit and profitability. The thesis aligns with the concentration area of International Law and Sustainability within the Doctorate Program in Law at the Federal University of Santa Catarina. This adherence is evident in its treatment of globalization, the contemporary ecological and climate crisis, and the problems arising from the capitalist economic system. The research also fits within the research line of Ecological Law and Human Rights, bringing Ecological Law as a foundational theory and framework for constructing an ecological method of legal interpretation. Methodologically, the thesis adopts multiple approaches. The inductive method starts from the specificities of the current economic system to generalize the formation of a new paradigm. The hypothetical-deductive method applies the Legal Guidelines for Eco-Regeneration to define new perspectives for Brazilian Agricultural Policy. The structuralist method begins with the analysis of concrete phenomena, such as the problems stemming from globalization and the economic system, to formulate an abstract theory based on ecological and regenerative foundations. In summary, the work proposes that Law should assume an active role in the transition toward a regenerative economy, capable of reconciling economic development with ecological integrity, based on a legal paradigm that values biodiversity and regeneration as the foundations of a new economic and social rationality.

Por décadas, a Lagoa da Conceição tem ocupado um lugar central no imaginário da Ilha de Santa Catarina: inspiração de canções, espaço de lazer e contemplação, território de sobrevivência para muitos e alvo constante da especulação imobiliária e da exploração turística. Foi nesse contexto que, em 25 de janeiro de 2021, ocorreu o rompimento da lagoa de evapoinfiltração da CASAN, evento que expôs de forma abrupta e traumática uma estrutura crônica de negligência institucional e dano ambiental. A partir dessa realidade, a pesquisa buscou compreender como os moradores e moradoras da Lagoa percebem os danos sociais e ambientais provocados por esse rompimento, investigando se o evento é visto como algo pontual ou como parte de um processo mais amplo. Também se analisaram as formas de resistência e reconstrução da memória coletiva diante do trauma vivido, dando centralidade às vozes dos atingidos. Trata-se de pesquisa qualitativa, com aplicação do método de abordagem indutivo ? a teorização será erigida a partir dos dados reunidos na pesquisa de campo. O método de procedimento adotado é o monográfico, enquanto os procedimentos técnicos envolvem pesquisa bibliográfica, documental e empírica. A primeira parte da pesquisa é dedicada a aspectos teóricos, com revisão sistemática da literatura sobre criminologia verde, crimes estatais-corporativos, vitimologia corporativa, conceito e fatores sociais, econômicos e políticos dos danos ambientais corporativos, e processos sociais, econômicos e políticos que antecederam o rompimento na lagoa de evapotranspiração da Lagoa da Conceição em Florianópolis/SC. A pesquisa empírica foi realizada por meio de entrevistas presenciais semiestruturadas com pessoas atingidas pelo rompimento da barragem, aplicando-se a Teoria Fundamentada em Dados. Ao final, são apresentadas três categorias analíticas centrais: ?memória?, ?naturalização do dano? e ?estranhamento?, sendo a ?memória? compreendida como uma ferramenta de resistência contra a ?naturalização do dano?, e ?estranhamento? a zona de intersecção entre as outras duas categorias. Conclui-se que o rompimento da lagoa de evapoinfiltração é lido pelas pessoas atingidas como o resultado de um processo contínuo de negligência institucional, e não um acidente isolado. A dissertação se alinha à área de concentração \"Direito, Política e Sociedade\", e mais especificamente à linha de pesquisa \"Historicismo, Conhecimento Critico e Controle Social\", do Programa de Pós-Graduação em Direito da Universidade Federal de Santa Catarina (PPGD/UFSC), bem como ao Projeto Coletivo Criminologia Critica, Políticas Criminais e Sistema Jurídico Penal\", ao criticar as estruturas de controle social, destacando como a vitimização corporativa fragiliza o controle informal e exige uma revisão do conceito de dano colateral. Além disso, analisa as limitações do Sistema de Justiça, especialmente penal, na proteção das vítimas de crimes corporativos.; Abstract: For decades, Lagoa da Conceição has held a central place in the imagination of Santa Catarina Island: an inspiration for songs, a space for leisure and contemplation, a territory of livelihood for many, and a constant target of real estate speculation and tourism development. It was in this context that, on January 25, 2021, the rupture of the evapoinfiltration pond operated by CASAN occurred, an event that abruptly and traumatically exposed a chronic structure of institutional negligence and environmental harm. Based on this reality, the research sought to understand how the residents of Lagoa perceive the social and environmental damages caused by this rupture, investigating whether the event is seen as an isolated occurrence or as part of a broader process. Forms of resistance and the reconstruction of collective memory in the face of the experienced trauma were also analyzed, placing central emphasis on the voices of those affected. This is a qualitative study, applying the inductive approach method, with theorization to be built from the data gathered through field research. The procedural method adopted is the monographic method, while the technical procedures involve bibliographical, documentary, and empirical research. The first part of the research is devoted to theoretical aspects, with a systematic review of the literature on green criminology, state-corporate crimes, corporate victimology, the concept and social, economic, and political factors of corporate environmental harms, and the social, economic, and political processes that preceded the rupture of the evapotranspiration pond at Lagoa da Conceição in Florianópolis, Santa Catarina. The empirical research was conducted through in-person semi-structured interviews with individuals affected by the dam rupture, applying Grounded Theory. In the end, three central analytical categories are presented: ?memory,? ?naturalization of harm,? and ?estrangement,? with ?memory? understood as a tool of resistance against the ?naturalization of harm,? and ?estrangement? as the zone of intersection between the other two categories. It is concluded that the rupture of the evapoinfiltration pond is interpreted by those affected as the result of a continuous process of institutional negligence rather than an isolated accident.The dissertation aligns with the concentration area \"Law, Politics and Society,\" and mote specifically with the research line \"Historicism. Critical Knowledge and Social Control\" of the Graduate Program in Law at the Federal University of Santa Catarina (PPD/UFSC). as well as with the Collective Project \"Critical Criminology. Criminal Policies and the Criminal Legal System.\" It critically examines the structures of social control. hughlighting how corporate victimization weakens informal social control and calls for a reassessment of the concept of collateral damage. Furthermore, it analyzes the limitations of the Justice System ? particularly in the criminal sphere ? in protecting the interests of victims of corporate crimes.

Com o advento do Código de Processo Civil de 2015 a temática ?precedentes? ganhou força no Brasil. A utilização de decisões anteriores como parâmetro de decisões futuras há muito é objeto de estudos mundo afora e é frequentemente relacionada ao instituto do precedent oriundo da common law. O presente trabalho possui como objetivo central a identificação do que é o precedente no Brasil e a sistematização teórica e operacional em nosso ordenamento jurídico. Parte-se da hipótese de que o \"precedente à brasileira\" possui contornos singulares e pragmáticos que o distanciam da teoria clássica do precedent desenvolvida na tradição da common law. O trabalho é produzido em sintonia com a área de concentração ?Direito, Estado e Sociedade?, do PPGD/UFSC, já que trata diretamente da forma de organização da estrutura judiciária brasileira e da aplicação do direito jurisprudencial. Para este propósito, tendo como referência de base a pesquisa bibliográfica, o estudo inicia-se com a identificação da teoria do precedent do direito comum, seu desenvolvimento histórico e institutos principais. A partir daí, verifica-se como sistemas jurídicos ocidentais passaram a incorporar institutos jurídicos de tradições diversas (civil law e common law). Nesse contexto, trabalha-se com as funções das Cortes de Vértice e os elementos que justificam a adoção de um sistema de precedentes. Na sequência, identifica-se que o núcleo do que se identifica como ?sistema de precedentes? no CPC/2015 existe com vistas a combater problemas quantitativos e qualitativos do Judiciário. Ou seja, volta-se à solução do assoberbamento das Cortes e Tribunais. Em seguida, busca-se identificar e sistematizar as disposições do CPC/2015 com o tema, abordando-se cada um dos indexadores jurisprudenciais elencados no art. 927 e as previsões do art. 489. Estabelecidas as premissas teóricas e fáticas, debruça-se sobre a sistematização dos precedentes obrigatórios à brasileira a partir da identificação dos seguintes elementos: quais são; por que obrigam; o que obriga; quais os critérios de formação. Conclui-se que, no Brasil, o legislador prestigiou a resolução de demandas idênticas a partir dos indexadores jurisprudenciais do art. 927, aos quais este trabalho refere-se com precedentes obrigatórios, cujo elemento central é a tese jurídica. Concomitantemente, há os precedentes, que consistem em qualquer decisão anterior que venha a ser utilizada como parâmetro de solução para um caso idêntico ou análogo para o futuro, que têm como núcleo a ratio decidendi. Quanto a este aspecto, o legislador não trouxe disposições suficientes para que se afirme que estamos mais próximos do precedent da common law. De qualquer forma, observa-se uma atenção maior ao precedente e o olhar para a teoria estrangeira pode nos auxiliar a desenvolver uma cultura que prestigie o stare decisis. Esta é, entretanto, uma mudança gradual e que exige uma virada cultural, não sendo suficiente a alteração legislativa; Abstract: With the 2015 Code of Civil Procedure, the theme \"precedents\" gained momentum in Brazil. The use of previous decisions as a parameter for future decisions has long been the subject of studies around the world and is frequently related to the institute of precedent originating from the common law. This study has as its central objective the identification of what precedent is in Brazil and its theoretical and operational systematization within our legal system. It starts from the hypothesis that the \"brazilian-style precedent\" has unique and pragmatic contours very different from the classical theory of precedent developed in the common law tradition. This work is produced in line with the \"Law, State and Society\" concentration area of the PPGD/UFSC, as it directly addresses the organizational structure of the Brazilian judicial system and the application of case law. For this purpose, having bibliographic research as reference, the study begins with the identification of the common law theory of precedent, its historical development, and main institutes. From there, it verifies how Western legal systems began to incorporate legal institutes from different traditions (civil law and common law). In this context, the functions of Apex Courts and the elements that justify the adoption of a system of precedents are examined. Following this, it identifies that the core of what is identified as the \"system of precedents\" in the 2015?s Code of Procedure, exists to combat quantitative and qualitative problems of the Judiciary. That is, it aims to solve the overburdening of Courts and Tribunals. Next, it seeks to identify and systematize the provisions of the 2015?s Code of Procedure on the subject, addressing each of the jurisprudential indexers listed in article 927 and the provisions of article 489. Once the theoretical and factual premises are established, the research delves into the systematization of mandatory brazilian-style precedents based on the identification of the following elements: what they are; why they are binding; what exactly binds; and what their formation criteria are. It is concluded that, in Brazil, the legislator prioritized the resolution of identical demands based on the jurisprudential indexers of article 927, which this work refers to as mandatory precedents, whose central element is the legal thesis. Concurrently, there are precedents, which consist of any previous decision that may be used as a solution parameter for an identical or analogous case in the future, whose core is the ratio decidendi. Regarding this aspect, the legislator did not provide sufficient provisions to affirm that we are closer to the common law precedent. In any case, greater attention to precedent is observed, and looking at foreign theory can help us develop a culture that values stare decisis. This is, however, a gradual change that requires a cultural shift, as legislative alteration alone is not sufficient.

A dissertação investiga a relação entre o Movimento do Direito Alternativo (MDA) e as Assessorias Jurídicas Populares (AJP/AJUP), com ênfase na década de 1990 e na experiência do SAJU/UFSC, a fim de compreender em que condições o Direito opera como instrumento de luta. O problema de pesquisa consiste em identificar se existe, e de que modo se estabelece, uma relação de continuidade entre o Movimento do Direito Alternativo e as Assessorias Jurídicas Populares, especialmente no que se refere à apropriação, reelaboração ou tensionamento do arsenal teórico produzido pelo alternativismo jurídico e por suas correntes contra-hegemônicas. A pesquisa adota metodologia empírica, com abordagem qualitativa de inspiração histórico-estrutural e uso de história oral, articulando análise documental e entrevistas semiestruturadas com magistrados, docentes, advogados populares, militantes e estudantes. A investigação discute o contexto pós-ditadura e as disputas em torno da efetividade da Constituição de 1988, a crítica ao positivismo jurídico e à neutralidade judicial, as influências do pluralismo jurídico, da teoria crítica, do garantismo penal e do ?Direito Achado na Rua?, bem como os processos de institucionalização e as tensões internas do MDA. Os resultados demonstram que as AJPs traduzem a alternatividade em práticas territoriais de escuta, educação popular e estratégias jurídicas coletivas, ampliando o acesso à justiça e contribuindo para a formação de juristas críticos. No que se refere à continuidade, a pesquisa evidencia que não há reprodução linear do MDA pelas AJPs, mas uma continuidade reorganizada, na qual elementos do alternativismo ? como a crítica ao formalismo, a centralidade do território e a defesa de interpretações constitucionalmente comprometidas com a realidade concreta ? são apropriados, tensionados e atualizados pelas AJPs em novos contextos sociopolíticos. Embora a hegemonia positivista limite respostas adequadas às demandas coletivas, práticas como o positivismo de combate e o uso tático do Direito, tal como mobilizadas pelas AJPs, demonstram que a legalidade pode ser tensionada e reinterpretada quando vinculada a processos de organização popular. A prática extensionista e popular ressignifica o Direito ao coproduzi-lo com sujeitos subalternizados, mobilizando uma hermenêutica constitucional enraizada na realidade social. Desenvolvida na Área de Concentração Teoria e História do Direito, a pesquisa insere-se em uma perspectiva crítica que compreende o Direito como fenômeno histórico e socialmente situado, vinculando-se ao Projeto Coletivo ?Direitos Humanos, Antropologia e História da Cultura Jurídica?, ao contribuir para a compreensão da cultura jurídica e das práticas contra-hegemônicas comprometidas com a democracia e a justiça social.; Abstract: This dissertation investigates the relationship between the Alternative Law Movement (Movimento do Direito Alternativo ? MDA) and Popular Legal Advisory Services (Assessorias Jurídicas Populares ? AJP/AJUP), with an emphasis on the 1990s and on the experience of SAJU/UFSC, in order to understand under what conditions law operates as an instrument of struggle. The research problem consists of identifying whether there is, and how it is constituted, a relation of continuity between the Alternative Law Movement and Popular Legal Advisory Services, particularly with regard to the appropriation, reworking, or tensioning of the theoretical framework produced by legal alternativism and its counter-hegemonic currents. The research adopts an empirical methodology, with a qualitative approach inspired by historical-structural analysis and the use of oral history, combining documentary analysis with semi-structured interviews conducted with judges, professors, popular lawyers, activists, and students. The study discusses the post-dictatorship context and the disputes surrounding the effectiveness of the 1988 Constitution, critiques of legal positivism and judicial neutrality, the influences of legal pluralism, critical theory, penal guarantism, and the ?Law Found on the Streets,? as well as the processes of institutionalization and internal tensions within the MDA. The results show that Popular Legal Advisory Services translate alternativism into territorialpractices of listening, popular education, and collective legal strategies, expanding access to justice and contributing to the formation of critical legal professionals. With regard to continuity, the research demonstrates that there is no linear reproduction of the MDA by the AJPs, but rather a reorganized continuity in which elements of legal alternativism?such as the critique of formalism, the centrality of territory, and the defense of constitutionally grounded interpretations committed to social reality?are appropriated, challenged, and updated by AJPs in new sociopolitical contexts. Although positivist hegemony limits adequate responses to collective demands, practices such as militant positivism and the tactical use of law, as mobilized by AJPs, demonstrate that legality can be strained and reinterpreted when linked to processes of popular organization. Extension-based and popular practice resignifies law by coproducing it with subalternized subjects, mobilizing a form of constitutional hermeneutics rooted in concrete social reality. Developed within the Area of Concentration Theory and History of Law, the research is grounded in a critical perspective that understands law as a historically and socially situated phenomenon and is linked to the Collective Research Project ?Human Rights, Anthropology, and the History of Legal Culture,? contributing to the understanding of legal culture and counter-hegemonic practices committed to democracy and social justice.
