A problemática do trabalho reside em compreender adequadamente o conflito enquanto fato social transformador que, quando bem trabalhado, fortalece a relação entre as partes. Para tanto, utilizou-se a metodologia lógico-dedutiva combinado ao estudo da doutrina e legislação. Como resultado, verificou-se que a adoção de postura cooperativa no litígio possibilita a multiplicação dos ganhos individuais e, com isso, o alcance de ganhos coletivos. Como principal contribuição do trabalho, tem-se que, quando aliados com as técnicas de negociação do método Harvard e a teoria dos jogos de Nash, o uso dos procedimentos autocompositivos é extremamente eficiente para a solução dos litígios, notadamente, por proporcionar ganhos múltiplos.; This article aims to explain the negotiation techniques used in mediation and the resulting benefits, in particular, the Harvard method and game theory. The problem of work lies in properly understanding conflict as a transformative social fact that, when worked well, strengthens the relationship between the parties. For this, the logicaldeductive methodology was used combined with the study of doctrine and legislation. As a result, it was found that the adoption of a cooperative stance in the litigation enables the multiplication of individual gains and, with that, the achievement of collective gains. As the main contribution of the work, it has been that, when allied with the negotiation techniques of the Harvard method and the theory of Nash games, the use of self-compositional procedures is extremely efficient for the solution of disputes, notably, by providing multiple gains.
